Me too. This is completely mad.
 
I suspect that there is a arguement that the data held could lead to a revelation of a individuals sensitive personal information in that it could reveal tinformation about a individual's physical or mental health or condition... however it is very clear under section 32 of the act that material processed to allow the publication of any artistic material is exempt... and clearly under the Copyright Legislation the material is of a artstic nature.... So... I think that the whole system must be exempt under section 32.


We are exempted ourselves under section 32.... and this has been confirmed with the Data Protection Registrar.
 
I am always taking pictures of other boats, I would like to put them on your site, but I am not at all computer literate!
Soon we wont be allowed to take pictures of peoples boats and cars in the same way we are not allowed to photograph childrens school plays or sporting events, its a strange world.
 
uploading to the site is very easy
click "Browse" then chhose where to find the files.
as you have connected your camera via a usb port you will "goto" my computer "goto" mass storage device & open. you will find the files you want to upload, then highlight & open
 
Data protection is indeed a complicated area, but I have some reason to be concerned that the publication of boats, stored on myboatpix, on YBW may be a problem for us. It's clear most people here are happy to have their pictures shown, but it only takes one person to take exception for us to fall foul. I'm afraid we have to be whiter than white as part of a big corporation (Time Warner).

There is a picture of me (on my old boat) on Page 35 of the current ("June") edition of Yachting Monthly. I have neither been asked for nor given my consent for this to be published. Especially considering that this is part (all be it a small part) of a publication which is making money out of a photo of me. Am I entitled to royalties ? Should they have asked for permission ?

Some double standards here. I think.

I would rather be on Schmoos site - I might get a nice photo of my boat. I gain nothing from the photo in YM. And the constant Paps interest is such a bore

(Incidentally the captions says "...people would rather not raft on strangers.." We weren't strangers at the ending of the evening after much beer/wine had been imbibed and many stories told)

Why, Dan?

According to the preamble to the Data Protection Act itself this is "An Act to make new provision for the regulation of the processing of information relating to individuals". The Act controls the use of 'personal data', and 'personal data' is defined by the Act as follows - “personal data” means data which relate to a living individual who can be identified— (a)from those data..."

In what sense is a picture of a boat data from which an individual can be identified?
 
In fairness, I suspect that Dan, working for a huge international media company has access to more DPA expertise than any of us can imagine....

So while I still decry the state of our society, I have little doubt that Dan has received sound advice from within!
