One would however suggest that the name was obviously in the public domain and I don't think anyone made a libellous comment ..did they?

But does it really matter if we conduct BB conversations which are totally distanced from the subject of boating?. MBY and this BB have obviously forged a number of relationships which have been 'enabled by this BB. Consequently it can not be totally surprising that BB 'members' use the Board for converstaions/discussions around a broad range of subects? The one thing that we do share is an interest in Motor Boating in one of its many forms.

I could FREQUENTLY have been accused of not belonging to this forum as my knowledge is so scanty but everyone puts up with me ( well almost all).

I would also (respectfully) suspect that the chances of IPC or MBY being investigated let alone prosecuted for the use of that name is the square root of the square rooot of FA. I do ,however, accept that it is unnecessary.

And anyway I'm in a foul mood cos my knee is all banged up , cos I've done the ligament thingy in..

...I wanna boat please..
 
You're totally right, I don't give a stuff who it was and being in Norway, still don't know the name, I will say, the BBC on there E mail news, have still not released any name, so maybe it is still a legal minefield! But no name was ever given out on this website, was it? If it was I missed it!
 
A) I now agree after hearing a legal oppinion on TV last night that you are not mitigated by that fact that someone else has previously mentioned the name.

C) How can Dom have deleted PaulinB's post ???? Is this a super user status bestowed on the trusted or does he work for IPC, I am assuming Dom = Depsol.

That wasn't my problem; but all I'm saying is we're not overkeen to spend time keeping an eye on a bit of non-boaty tabloid gossip that may have encouraged users to post comments that even some national newspapers are currently not prepared to print.

We're not really here to play the odds on stuff like that; the forums are public and are read by a wide audience. I see plenty of national media IP addresses over the course of a month. So we're quite happy not to get jointly cited. As we said before the fact that a name is public domain is no defence whatsoever for republishing the name if it all goes wrong.

As for the knee, well sorry about that. If it's any consolation one of my two valuable typing fingers got badly mashed between two bowling balls at a skittle alley on Tuesday night. Don't ask how...

Not from my perspective. For much of the time everyone is left well alone. Bans are extremely rare; permanent ones even more so. When it happens there is a very good reason for doing so.

Legal dept not on my back. The whole point really is that if that ever happened (never once in the two years I've been running these sites) we've probably failed to keep things on an even keel anyway.

Alright, alright enuff of this tittle tattle.....I'll own up it was me. Well her really, I couldn't do a thing about it. I was pinned down struggling like hell, but alas I had to succome. What can I say it was horrible.........er wasdat dear time to get up, already.....I was having such a nice dream........its sunday you say..........oh god! I've gotta go and polish that damn boat!

....I'm not owning up to how I did my knee in till TCM is back on the forum...STOP...suffice to say it was stupid !


As someone who also gets 'cited' quite often, learnt that you can not be 'safe' every time...if you are , you just died and became a lawyer..
