This story does'nt stack up to me. If the yacht passed only a couple of yards in front after the ferry slowed etc etc then presumably if the ferry had maintained its speed then the yacht would have either passed behind or been forced to tack as it approached the ferry's side. The yacht skipper must have thought the ferry was being polite to excess by slowing down to allow him to pass ahead.

Whilst the exclusion zone around large shipping, the zone of concern as it is known, is for the >150m lot, I am pretty certain that there is a by-law about merchant traffic in Southampton Water and down to Snowdon. Certainly it is fairly well accepted by everyone I sail with from Southampton.
Indeed a recent open letter from Southampton HM to all the local sailing organisations highlighted a recent trend in near misses and referred specifcally to ferries. Sadly I do not have it to hand and VTS' website appears to be down.

Some ferry skippers do tend to only think with the whistle. Maybe there was some reason for the ferry not making a minor alteration to avoid the X-boat. Sometimes the exact path a ferry will take is quite hard to predict.
By the way, since anyone can look in the Solent Yearbook and see who owns that boat, I would avoid derogatory name calling. The x-fleet is rotten with lawyers.
 
Well ... having read on through the thread .. I am sitting here wondering where all this extra detail came from that some seem to post .. The article itself is short and plain.

IMHO there is one short comment that seems to fit the bill : What a stupid dinghy helmsman.

Regardless of what leads up to the photos ... anybody who argues with a large lump of steel ship has to be certifiable..... particularly in a dinghy !

We all can shout and moan about Ferry Drivers - but they pligh those waters day in day out .. how many accidents / collisions do you read about despite the number of hooray henrys out there ? Are people really going to say that Ferry driver didn't know what he was doing ?

There are always alternative rules. Take for example motorway driving. While the highway code says traffic already on the motorway has right of way, there are plenty of people who think they have the right to barge in regardless.

In our single-track country lanes the unwritten rule is that it is the person nearest a passing place who reverses. Once in a while you meet a woman who thinks the man should reverse, no matter how far and then there are young men who think the one with the most testosterone has the right of way.

In this instance, on the evidence in the article, the sailing boat was the stand-on vessel. For the ship to fail to give way may have become a local custom but I wonder what a court would decide if they had collided.

What puzzles me is that one x-boat is on its own. They normally hunt in packs.

I sail out of Portsmouth and live with a view of the harbour mouth. I have seen bloody minded stupidity from both Wightlink and yachtsmen. I expect its similar in mid solent. I see no point in judging this incident with so few facts.

I wonder if its coincidence that the Port of Soton website looks broken?

Mariners are advised that many warships and merchant vessels (including ferries) operating within the Dockyard Port of Portsmouth and the Port of Southampton are at various times “vessels constrained by their draught or vessels who can safely navigate only within a narrow channel or fairway.”

Save for the exception at Paragraph 3 below these vessels, when so constrained, are all to show the signals prescribed in Rule 28 of the International Regulations for Preventing Collision at Sea , i.e. three all-round red lights in a vertical line, or a cylinder, in order to be afforded the privileges of Rules 8(f)(i) and (ii) (Actions to avoid collision), 9 (Narrow channels) and/or 18(d)(i) (Responsibilities between vessels when one is constrained by draught).

So many of your posts are like Trolls but this one does raise some good points.

Must remember to post questions with insufficient information but only the unusually conclusion to get everyone going.

Mix in Sail v Motor, Co Regs, Bigger v Smaller and what distance is clear to avoid a collision and what a winner you have.

Would like to know whether commercial ships (other than those over 150m lg) have any extra rights over sailing/pleasure boats in Southampton waters though.

By definition then this does not apply to I of W ferries as these are not constrained by their draught except obviously in Lymington and the channel going to Fishguard & Yarmouth.

S we are back to Col Regs apply and X boat is Stand on and photo does not represent Jimi/Flaming's or my experience so not enough info to explasin this situation.

No. I sail there every week and am damn sure what the rules are. Leisure-craft give way to merchant shipping, which includes ferries.

I just can not give you chapter and verse.
