VAT Petition - UK Boats in the EU

What about HMRC notice 8

  • You write to them and see what they say , if not want you think if mean .
This is the bit everyone's including UK owners need to be awere off

This mean before you get in your car to drive to the marina for the week end you have to carry probe UK VAT as been paid if stopped .

The HMRC on the 18th December 2020 published Notice Number 8 entitled:
‘ Sailing your pleasure craft to and from the uk ‘
This notice is in my view says if you are vat paid in EU , your can sail to Northern Ireland without a Q flag and you will be both UK and EU vat status
Your point about having a vat paid invoice in your car driving down a motorway going to your boat , are you serious?

As for am I serious about carrying prove of VAT read what they say , it get worst for owners or per 1992 . How do you prove where the boat was when we join the EU .

Included, as such, are pleasure craft with VAT paid or deemed VAT status valid at 31/12/20, located in Great Britain 31/12/20. Deemed VAT paid includes certain vessels that were in use as private pleasure craft prior to 1 January 1985 and were in the UK or EU on 31 December 1992

I would appreciate if you could give me the HMRC declaration that I a wrong.
There is no back door , there is a EU border in the Irish Sea
You clearly suggested you should carry an VAT invoice in your car travelling to your boat.
This is effective from 2021. NOT 1992

And as for cars:
My car was bought in the UK in Oct 2007, it was exported to Belgium Dec 2020, it is going to be fun when I try to drive back to my house in Scotland :)
I paid VAT on the car in Scotland Oct 2007 and yes I have a screen grab of the sale of the vehicle to me as a new vehicle which I used to prove the vehicle had been VAT paid in the EU when I bought it. That's £10k of VAT I do not want to have to pay again, or any other amount, you should not be taxed twice on the same item.

I rest my case for you to explain my mistake
If your an Irish resident you can return back to Ireland but you must not stop any where in the UK mainland , if then you move become a resident say to Scotland you can then take the boat with you as part of your goods .
There already been some write up about this on different sailing forums where people have been in touch with HMRC ,
But of you want 100% prove , write to HMRC and tell them exactly what you want to do , which is sail a boat thats not UK vat status to Northern Ireland spend a night there then sail it to the UK and see what reply you get .
 
And as for cars:

This will depend where you are resident now and where the car is registered, if any thing like boats then if your residency is Belgium and the car registration is also Belgium you be OK .
 
I believe if HMRC get away with this, they will be required to change their name to:

Her Majesty's Robbery or Criminalise - Otherwise they risk getting sued under the Trade Descriptions Act :oops:
A relation used to work for an accountancy firm BDO, it was hinted at the initials stood for Bende Dikke Oplichters - I'll let you do the google translate on it ;)
