However I see a snag. The letter says 'the onus of proving that full duty has been paid remains with the purchaser.'

Now we all know that HMRC has accepted that a 60/40 split is acceptable, and they have all but said they will never query this. There is no guarantee that a receipt presented to an overseas customs person, that shows 60/40 split, will be accepted, especially as I believe most EU countries don't operate such a system. Might be wrong about that.

So I can see that the more 'awkward' nations, the Dutch come to mind, might want to cause trouble for us Brits.
 
You have to be careful about asking for a receipt confirming that duty has been paid too. Many places will just give you a handwritten piece of paper with the total amount shown and that doesn't prove anything
 
I don't think it gives the split on the receipt does it. Only bought 1 tank since nov and i can't remember.

As far as I'm concerned though there is a big danger in keeping all the receipts. My wife might find them.

Any way that sentence is over the page - the letterhead and page 1 will do the trick.
 
We have not filled up since October and not been out since.

All fuel used has been with the two erpsbatcher units that we have fitted. I have no idea, as yet, how much fuel we have used.

We have spent many weekends with the heating on to keep us warm.

So, if we fill up the tanks again on exiting the Marina what should we declare?

You are well within your rights to claim 100% domestic if that is what you have used it for.
Be prepared though, to prove it with reciepts and engine hours logged.

No, you can't do it retrospectively. The declaration is what you are going to use it for, in the future. If, say, you bought some fuel last year at 60/40, and as things turned out you used 100% on Eberspacher, you may not claim 100% domestic on your next fill up. For your next fill up you must estimate what you are going to use that axshull fill up for, (though 60/40 will in practice be accepted without question)
 
Yes I think you are right with that snag Geoff. If you buy red in UK and get perfect paperwork it will show that 60% of what's in your tank is Tax-paid. There's nothing in that downloadable letter to say Mr Dutch tax man will accept the 60-40 estimate aspect, so he could try to charge you dutch fuel tax on 40% of your tank. Especially if you arrive in Holland having filled with UK red at 60/40 that morning, on a summers day with a cold eberspacher and no genset running.

Last 4 Months He's used 99'9% fer heating and the rest on cruising.

I know when his heater is working efficiently.
I was changing His oil and stuff and Me left ear is still medium rare.

I,d left a spanner by the outlet.

But surely a court cant convict you, on a wrong prediction on what was going to happen in the future. I know I've used 45 gallon for heating since November and more or less none for the engines. I know because I transfered 45 gallon from my in flight refueling tank into the tank that also runs the heating. The engines have used none, cos I cant get out the bloody marina.

So next year if I predict the same, it will all be for heating. Does that mean I have to stay put with the heating on, regarless of the weather. /forums/images/graemlins/confused.gif
