If it's Maldon Council then their mooring regs are quite clear about them removing any vessel in and unsafe or unseaworthy condition and charging the owner for costs involved in the removal.

Actually i have made a careless mistake here -- apologies -- i described the officer as harbour master , he is in fact the river baliff
Any way thanks for the byelaws. There is a clause re insurance which contradicts what the baliff tells me ie he says byelaws do not state insurance is required which is wrong as displayed in regs

Seems pretty clear your River Bailiff has the powers to deal with it. My guess would be that he and the the council is unwilling to risk spending money they are unlikely to be able to actually recover.

You could involve the local MP, as suggested.
 
Trinity House recently removed the sunken motor boat at the Nass Beacon in the Blackwater., though a bit more into navigable channels.

We were lucky that TH defined it as a hazard to navigation as it was in the middle of the channel. West Mersea similarly has no harbour authority and therefore in the absence of TH taking responsibility (and they had a number of not cheap legal hoops to get through before they could assume rights to d dispose of the wreck) and then it must have cost a fortune with the lifting barge on site for an age.

Coastguard MSI broadcast gives it in St Lawrence Bay.
 
There is no harbour authority
The local council are supposed to collect rents but are a bit lax in this area. The harbour master for the area does not chase moorings much
The boat is in the river 200 yards out. We have no means of hooking it to drag it even if that was possible
As I said We feel we cannot touch it without incurring liabilities

As it is not your responsibility I wouldn't touch it. If you made a botched recovery attempt your responsibility might be called into question. It would appear that it is the local council's responsibility and perhaps a registered letter to them, pointing out that they are at risk in the event of an accident, might have the necessary effect.
 
Just a vague thought, but would the Navy be interested, as a clearance exercise ?

They might ask for funding though, nowadays.

Look old chap, you might work with with the light blue lot that march sideways, but the senior service is a little busy right now. We have a shed load of new destroyers sat in Pompey waiting for us paint, then there is the new carrier and Babcock have just started work on the second one. Sorry bit busy right now. Haven't you got some surplus harriers and pilots sat around in the Mess?

have a look at the little avatar pic, I've worked with nuts from all UK forces + others, my Dad was a dark blue type and XZ440 was my favourite aircraft to nail cameras on !

May I suggest that while the negotiations are in progress, someone ties a float to the masthead so we can actually see where it is. Having heard the CG warning, I kept a good look-out whilst passing, but didn't see anything either going out or coming back.

As an aside, there was no mention of the Osea Causeway obstructions; has that now been cleared?

I belive it was less than the reputed £5k that maldon is said to have charged another owner for a small boat that sank
In that instance i am told they just recovered ot & sent the bill. I hasten to add that is only what i was told by locals

It does, but they have a very specific definition of a wreck, which would not cover this scenario. In short, if the boat wasn't abandoned as part of a distress situation then the receiver of wrecks has no interest, and it is treated as an abandoned boat, not a wreck - which would be the case in the current scenario.

How about a picture? I would be interested to see what was at the centre of this story as I am sure others would.
