[ QUOTE ]
Your stance is based on ONE opinion from ONE Spanish lawyer.
[/ QUOTE ]It is based on legal advice received from a large reputable firm of Spanish lawyers. Better than a few retired British yachtsmen, none of whom are legally qualified, or even speak Spanish?
Still, it doesn't concern you, does it? You have absolutely no intention of taking your boat to Spain. You are here to stir. There are stirrers, and you are a perfect example.
That's the odd thing about this discussion. The people who say it's safe to take your boat to Spain have no intention of going there. It's very easy to say "stick your head up over the top and tell us what's happening, old chap" when you are forty miles behind enemy lines.
What bothers me about this is not the advice appearing here, in YBW, as folk can see it for what it is. A few retired bods, and one stirrer, pretending to be international lawyers. What is genuinely frightening is that this is appearing as official advice from the Cruising Association and the RYA. If those organisations are going to give out legal advice then they should have it checked by a lawyer and be prepared to give the source of the advice, and the basis of that advice.
While it's not my personal concern I do hope that members of those associations put pressure on the associations to take out appropriate legal indemnity insurance. There could be a very good case against them -- of £100,000 and far more -- if anyone gets done after following their advice.
