If a marina has a serial boat crasher who seems to lack even basic skills can a marina terminate their licence and ask them to leave? I would have thought they have a duty to protect other bertholders but curious to know how others have dealt with such issues?

Interesting question, I'm surprised the matter has not been dealt with by the victims, during a dark rainy night.

I was watching some miami boat ramp videos the other day and it amazes me how calm people on other boats are when clearly incompetent people are coming in next to them, right up until they crunch into them. Incompetence seems to be normal there in Miami EG:


But if someone seems hard of learning I'd give them an easy berth before banning them, that would probably be enough for most. Then if still a problem threaten expulsion if they don't agree to have a lesson. Then expulsion if they're genetically incapable as its just not fair on others and everyones insurance could go up not just the ones hit.

It has only once happened to me when our neighbour who generally sailed his 35-ish foot boat named after a racehorse singlehanded repeated bumped into us. When he bent a stanchion slightly we asked to be moved. He is still around I believe.

I filed a near miss report with the marina I used to be in when a motor boater almost T boned me and the boat on the next finger. Apparently on that particular boat it could only do 25 KTS forward or backward. The owner was spoken to and I was allowed to move berth. A year later the motor boat was sold having not moved again and was moved to another location.

There would come a point where the level of recent claims would mean that no insurance company would take them on. Marinas require each boat to be insured. Therefore they would no longer be able to have a berth.

But of course...if there were no claims...

Perhaps there ought to be a marina equivalent of the Tory party's "Men in grey suits" who used ( in the good old days) to tap on the shoulder of an incompetent Prime Minister and discreetly murmer that it was time to go: and he/she went. ?

?
Where we moor, it’s ‘huge amounts of stupidity brought on by an excess of lunchtime beer’ which causes the issues. Luckily we are on the inside of the pontoon, and the antics of the drunken visitors are a spectacle rather than a matter of concern.

Well I have suggested to the marina they check they hold evidence of insurance cover of offender and explained the concept of quiet enjoyment for tenants etc which seems might have a similar application to this scenario. Apparently other bertholders have today raised concerns (not quite a delegation but he’s on the marina radar) and so hopefully in current buoyant marina berthing market they might be able to serve notice on the offender who at least currently is well away on a hammerhead somewhere after not returning to his berth. I don’t think bertholders or the marina really want the hassle of such people. No drunkenness involved I hasten to add.

That would be my answer to.. can't imagine the marina will care providing all the insurance is up to date - they certainly wouldn't go to the cost of giving miscreants tuition... bet they also have a notice up/contract statement like in car parks "we are not responsible for any damage incurred while in this marina"...

I would think that they can. I know of instances where berth holders have been given notice to vacate and others have not had their contracts renewed.
There may be small print that gives them the right to cancel at any time ?
Our sailing club banned a member from using the pontoon due to collisions every time he turned up .
