My contact tells me that Russians are flying to Switzerland to meet their agents and arrange their vessels be brought from Caribbean for this year's Med booked charters. They have had trouble getting bunkered over there for the trip, but there's always someone who will do it, of course. I said, aren't they frightened of the superyachts being impounded? Seems not - they are tied up with so many shell companies that no one knows who they belong to (except the agents, I presume).

It might be a problem when their lawyers end up at the ECJ arguing that their goods have been taken from them against their rights under the ECHR. Protocol 1, Article 1 gives rights to peaceful enjoyment of your property. They can probably still afford the usual suspects to act for them.

Yes, but when there's "A word in your ear, old boy" about the political desirability of a delay, I would see that trumping the fees. When you become a judge, promotion requires political nous.

Maybe, but you have to have nous to be promoted to the bench (I mean High Court, of course) in the first place. Once there you are more independent (unless you dream of the appeal court). But you are always from the bar and think huge fees are only what the bar deserves. And if parties want to speed things up they have various procedures and access to appeal - the latter being ex bar, too.

Every attempt to reduce civil court costs has been stymied by the judiciary itself.

This was one of my research areas for a couple of decades. Very interesting area. My own feelings are go the German (& other countries) way - judges are recruited young from law school. Germans know exactly how much going to court will cost (not much) before they begin any action. In the UK you just know it will be a fortune.

It will be Interesting in a voyeur way to see what gets fudged through and how long and how it is presented to the millions of Europeans complying with the law..
And indeed, if and when Big Boat rocks up in Europe with full tanks , will the fuel receipts be looked at too? And who will still charter and how will Sir be paying and to whom and where do the charterers expect to be able to visit ..??
Lots of Ifs, buts and yer buts .
