It's been a lively debate so far. It does demonstrate that the regs are far from clear on this point to (whether to engineers, lawyers or indeed yachtmaster instructor examiners).

Well said. We all have engines and all suposedly responcible. Restricted wateres require engines. Al otheres should be sailing way out of the channel. Anyone sailing in a spot that other boats are going to is restricted. So keep out of chanel. Ity 's quite clear in coregs. Just cos your racing does not make any difference.Boats going up and down the channel still have right of way. Stick on tin helmett at this time!!

Yes, great fun. I of course always keep a waterproof copy of the colregs posted next to the steering position together with the abridged version of the Admiralty law reports just in case I find myself in a situation like this and need to look up a case in a hurry :)

Please do not confuse ...

My post actually does not agree with the PD if I have engine running .... I only say that I will not argue with anyone the pros and cons when its lives at stake and I can open throttle into gear and get out of the way if other idiot doesn't !

I think that the original question is really not necessary as we all have an obligation to Prudent and good seamanship on the water ... a fact that the courts have exacted on many vessels over the years by proportionate blame ..... there are no cases of 100% blame that I know of in marine accident cases involving 2 or more vessels !!! QED !

Not sure that's right TCM. The documentary earlier this year about Volvo rtw race had the ceremony when they put it into gear, not when merely turned engine on. I remeeber scene where skipper made emotional speech to crew (engine alreddy on tickover in background) "when I push this lever and put engine into gear, we're outta the race bla bla cry cry"

Engine was used for battery charging, I think they were sealed in neutral, once the seal is broken they were out of the race.

This has nothing to do with that thread !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
