Re-Registering Spanish Flag to Jersey Flag

Hi all, Travelling to Tenerife next week having a look at a few motor boats on the island, plan is to spend winters down there, sunshine and fishing and not flouting the 183 day rule on residency, i got in touch with "Abogadomaritimotenerife" who specialises in Abanderamiento de buques, ie changing the spanish flag to one of Jersey, the estimated cost of de registering the spanish flag and checking all paper work was going great but then i got an email saying i could keep the boat with the spanish flag if i was to have them act as my legal representative, so no need to change flag to one of Jersey even though i am not spanish resident, question is does anyone know what the pros and cons are of keeping the spanish flag flying on the boat.

As I understand it, if the boat is Spanish flagged then you have to comply with Spanish laws regarding its use, especially holding Spanish sailing qualifications. By changing to UK or Jersey flag you can get round this requirement. Why do you want to use the Jersey flag rather than the SSR which is cheaper and doesn't require a survey?

Yes, being a resident of Jersey i will be eligible to register for SSR, and just my wish to fly the red ensign flag of Jersey as it is my home and the spanish flag as courtesy
.. i will check with the abagado about the qualifications i hold and if i need to retake them in Spanish. thanks for the answer..

This has already discussed at length before but can’t be arsed to did out that thread.

In your case, why not just send off for an SSR registration (£25 for 5years) and then return the Spanish documents to the Spanish authorities.

If you want to be really sneaky, when re-registering, change the boat’s name (Winsor Blue Of Teddinton❓).

Use your UK ICC as your certificate of competence to command - job done.

If you are non-resident but keep the boat on the Spanish flag, there is no need to take Spanish qualifications but your ICC will cover you.

OK. De-register then re-register all legal and above board.

Suspect if you did it in the opposite order nothing would happen - especially if you change the boat’s name.

The Spanish skipper qualification requirements are irrelevant of the flag, the license should match the skipper's nationality (in your case: ICC). Only the requirements regarding the boat (surveys, equipment, etc) change with the flag.

That is not true in Spain where you need a Spanish licence to skipper a Spanish flagged boat. That is a big barrier to a non Spaniard who wishes to buy a boat in Spain, hence the popularity of registering under a different flag.

Come on now - the SSR is a joke. Its routine to register with a length that helps in foreign marinas. Who is ever going to check?

I see you have chosen the name of a nice Ferrari model. Do you have one? Whats it like?
