Mike, the bit you are missing out is Rule 13(a):
"Notwithstanding anything contained in the Rules of Part B, Sections I and II, any vessel overtaking any other shall keep out of the way of the vessel being overtaken."

In other words, it doesn't matter what the overtaken boat does, the overtaking boat still has to keep clear.

There is a possible solution in the Rules under Rule 34. Power driven vessels are required ("shall") to give 1, 2 or 3 blasts to warn of manoeuvres. There's no reason why sailing boats shouldn't give similar signals to warn of tacking. Only problem is would the other vessel understand?

Not at all, just pointing out that we can all use one rule that makes us think we're right while ignoring the others

Also believe under rules you are not allowed to change course such that it would create a close quarter situation.

Problem only occurs with those who believe they own the water, suspect soon they,ll expect to be paid tolls similar to the new goverment proposals for roads
