As far as understand, an EU VAT paid boat is in free movement throughout the EU but best to check with Polish authorities if you suspect there may be some local rules. In some countries, boats could be taxable assets.
 
Hi, could anyone help with tax related question?
I'd like to buy a boat for the first time.
The boat was made in Europe, owned by an individual (not a company).
Thus, once VAT was paid in Europe.
Then a few years ago the boat was sold to a company registered in the state of Delaware, USA. The boat was also registered there, in the state of Delaware.
I think this is some kind of tax offshore, 'cos the boat itself was remaining in Europe.
I'd like to buy this boat and legalize it in Europe, under the Polish flag.
The question is, do I have to pay VAT again?
If I took such action in relation to the car, I would have to pay customs clearance (not VAT).
Is it the same with the boat?
Owned by a US company is irrelevant from a VAT point of view. This is quite a common event - not to avoid any boating tax but either to do with the owner's personal tax situation, or to enable a form of US registration of the boat because the owner is unable to register it elsewhere. Registration is also irrelevant for VAT purposes.

You should ideally get the original VAT invoice and sufficient evidence of chain of ownership, at least the last 2 Bills of Sale showing that the current owner has clear title to sell.

I would certainly want a detailed and bullet proof set of paperwork for the boat. Whilst it should be true that if the boat was originally VAT paid in the EU and has stayed there it should be OK - but you may have to convince a port / customs official or a future purchaser, and the more complex the story the more room for problems. Being technically correct may not help persuading a local official in a foreign language, if the paperwork doesn’t go all the way through.
