The buyers character... He is 78 with too much time on his hands. He is probably one of these retired people that had a respected position in life but after retirement found out people respected him for his job title not him personally. He is the type to write countless letters to various authorities complaining about the smallest thing as it makes him feel important still. He has probably joined the local PTA, council or golf club so he can be called a Chairman.

His purchase... It has been clear from the start he is not entitely happy with his purchase and he has been making you work because of this with a constant stream of mostly unnecessary texts over three months which counts as harassment in my book. He has piled on his dissatisfaction by saying that he has had to pay for work to be done to fix the tiniest of jobs that in his mind needed fixing! Over the months he has become more dissatisfied with the boat, and has got himself all worked up, especially as the boat has deteriorated over the past year in his own ownership of just sitting in a Marina without use. He had a tantrum about the windlass and you not sympathising with his position by not responding to his calls was the last straw and he wants his money back on his toy he doesn,t like.

He has got himself into this mess from the start due to his nature where the majority of others would have just got on with thnigs and worked it out themselves as you do in many situations in life. It,s amazing how people at such an age can be this way, they must have led very narrow lives. Just my take on the idiot LOL, I hope the guy mans up, fixes the windlass if indeed it needs fixing and gets out on the bloody thing for a sail! Some people make there lives so hard... I sincerely hope you have heard the last of this pratt Robin.

I'm not sure its ageist if its true...

Anyway, he's not saying that all aged people are like that because of their mature years. He's speculating that this particular man might be a product of his character, his previous job etc.

I once sold a boat to a guy just like that. He wasn't old, but he was short........:nightmare:

I searched it and it appears to be a rented condo complex with a mix of folk, young and old. I was suspicious as he had said he and his (NEw) 2nd wife had just sold one of their two properties and boiught out of the proceeds. Later I discovered via the broker he also had a loan of some kind as well.

SO TO answer to SAILAboutVIc, our sale was through a very respected brokerage , not private, The buyer employed a fully qualified marine surveyor had a full survey in and out of water and a sea trial under motor and sail albeit he would not take the helm personally at any time, even for a minute when I put sails away. All told the survey lasted from 9 am to 4 pm. The survey reported a bit of mould on a ply panel support for one of the two aircon units( noting it was not structuraland could be dealt with at leisure) and that the engine battery was flat and windlass Not operating. WE had our professional maintenance company replace the panel with a synthetic one at twice the cost of a ply one. We had a new engine battery fitted and this also had the windlass working as well. He has also said The surveyor was reluctant to run the tender outboard (9.9hp 4 stroke with under 2 hrs runtime and still under warranty) and he wanted proof of it working. Our maintenance guys replaced all the fuel in the outboard's separate fuel tank with fresh and proper marine ethanol free stuff despite the existing being only 2 months old, also ethanol free and well dosed with fuel stabiliser. The buyer was sent a video of the engine being started and running on the back of the RIB tender which was launched from it's davits for that purpose. It started first pull and ran perfectly as one would expect.


Our case is not similar to the other thread. We truly had the buyer from Hell, who initially was so pleased he even sent us a gift card for a local fine dining restaurant to say thanks for all we had done and the many extras given free of charge as we were retiring from boating,not intending buying another boat, leastways not in the USA. THE BOAT to my knowledge has never moved from it's berth since the day of the survey ( it has AIS transponder AND I check weekly out of curiosity). THE buyer now uses the same maintenance company that we did and they told me recently , off the record, they also have 'issues' with this plonker.

I was just pointing out , two case , from two side of the pitch .in one case the Op being told he should sue the seller he has a case and in the other case the OP being told not to take any notice of the buyer of threat of being sued he Not got a case.
I have to agree in your case I don't think the guy got a hopein hell,I am not even sure why you stressing over it .
In the other case I also don't thing OP as a hope in hell in any claim after a year and knowing very well the boat history to the extend of starting a thread here before he brought the boat and pointing it out to other .

I detect you're being reduced to a nervous wreck with all this, so a few medical notes from your doctor would be a good prelude to sueing him for harassment if he persists. I'm sure $25k would go some way to helping your nervous condition?

$50k would effect a complete cure.

That thought crossed my mind too buthis wife also showed up when I googled their address. however when he first started his crap, 4 months after closing, he was apparently spending days at a time on board whilst the boat guys did his 'modifications. One mod was to have a huge dock box installed right across the aft deck ( centre cockpit boat) for extra storage. it looked really stupid and anything in it would slide all over as the boat heeled if it ever went out. People from other boats nearby were laughing loudly and often conspicuously. I hate to think what he has done below decks, which was pristine:ambivalence:.

Mmmm it's like when you sell a house. Best to just stay ignorant of the atrocities the new owner has perpetrated to your previous pride and joy. But if he's hacked the boat about how could a claim of any sort be levied at you?
