Photographer in Solent today

He's moored up in Haslar today and his web site says he is in the Solent until the end of October.
This weekends photos taken in the solent are posted - unfortunately his website says they were taken in Plymouth!.

How is it that a photographer is allowed to take photos of yachts where people are easily identifiable and to make them available for sale? Do they get a model release from all onboard?

I'm really not sure. I am just curious. I always thought that it was illegal to sell photographs where the models are clearly identifiable without a release from the people in the photograph. I am just wondering what boat photographers do about this? Maybe it is because only the people featured in the photo can buy it? So I couldn't just buy any photo I wanted?

As the photo was taken in a public place, where you could not have reasonable expectation of privacy whilst sat in the cockpit of yacht - I suspect its not a problem for the intended market.

The thing is that you're in a public place, and as such you are free to be photographed, with the caveat "as long as it's not in a derogatory manner"

So you can be photographed on the street, on a beach etc

Images of you cannot be used for advertising without your consent (i.e. a model release form). But they can be used in an editorial context as long as it's generic, and not specific, so if there is a headline saying "Numpty yachty in sex scandal" and you pic is identifiable and you aren't the numpty yachty involved, then you would have a case against the publication

As for boatphotos, we bought a pic from them, good service and a good price. :)

So for example if a photographer took a snap of me in my keelboat and I am clearly identifiable in the photograph and the photographer went on to sell the photo as an art print for lots of money there is nothing I can do to prevent the sale of the photo?

What I dont get... is how on earth they do enough volume to make any money????

10 quid a print... figure costs em around £2..... but with say 2 peeps working full time, plus boat, overheads, website etc.... They need to be selling at least £250 a day to make any money... which means 30 prints a day... 365 days a year....
 
But I then could sue if the art print with my photo was sold to a company to use for advertising?

Maybe. Depends on the use and if its implied that you are endorsing a product, or if you are or are not included incidentally, but bear in mind that you will probably have to show damages to be awarded any.... and that may be difficult....

Firstly £10 is the smallest pic. A bigger pic will cost more. But I think the real money is in "corporate stuff" - so if you can get some corporate charter / day out with say 8 guests there - then as part of the nice "package" for the guests then they/thier hosts can buy prints for everyone. Magazine work, commerical shots for promotional literature etc - all adds £ - then I guess it depends if you are trying to make serious money or just maintain a lifestyle.

They're undercharging, I guess. I think we paid about $70 for this photo (along with a few others), but split between us it wasn't too bad - and a nice thank you to the owner (for letting me play with his boat for the day):
