Non lucrative Visa Spain (or France) for marina “residence”?

Has anyone actually got the Spanish (or French) non lucrative visa using a marina slip booking as a residence? Looking to live aboard- ultimately would like a residence visa to avoid the 90/180 non sense. Curious is possible.

Just looked it up and it seems the criteria that you have to meet for this visa is similar if not more difficult than going straight for a residence. Or am I missing something.

Residency - trouble is in some countries, residency brings with it a number of side effects, which may not be acceptable to the applicant.

Looking at the requirements I do not see much difference from normal residence criteria

• National visa form (available for download from your local Spanish Consulate website).
• Form Ex-01.
• Private Health insurance policy from a company authorsed to operate in Spain
• Bank certificate, demonstrating the possession of required funds per year.
• Photos, 3×4 cm with white background.
• Original Passport (minimum validity of one year and at least two blank pages).
• A medical certificate, demonstrating that you do not suffer from any restricted diseases.
• Criminal record translated to Spanish and legalised (issued by the country or countries where the applicant has resided in the last 5 years).
• Documents (original and stamped) to prove you have the required financial means through periodic and sufficient income or have an estate to guarantee the required income.

'The visa allows you to say in Spain for one year after entering the Spanish territory. You must spend a minimum of 183 days in the country to be able to renew. This also means that you will become tax resident and taxable on your worldwide income (subject to double tax treaties). '

Sorry maybe I should re phrase. Is there anyone who has any of the (longer stay) visas and is a live aboard in France or Spain? Would like to hear how the process went in general and how apt they are to accept a marina slip as a residence. The non lucrative visa in Spain seemed the easiest to get without having to buy/invest in Spain. France seems much stricter…..

You have to register on the Padron to get your residency. Not sure how you can to that with a marina address?

So I think we need a “residency” address for 4 things the 1-the intial visa application 2-the registration (certificat d’empadronement” 3- the NIE (may be provided automatically with the visa) 4 TIE
Im assuming if the consulate accepts it, that would be a start but that’s alot of steps in Spain…..

We have Spanish residencia (gained end of last year) and we signed on to the apadromento using the marina berth address. We do not own the berth but had proof of payments to the marina for 6 months previous.

You are definitely the person I need to consult! Im glad to hear they allowed it- at least for the apadromemto. Can you tell me your marina? If not, no worries. Was there any push back? Did you also apply for a visa based on the marina address? Or NIE etc Im assuming the marina address is also used for postal services?

Hi, we are in Gran Canaria so not mainland Spain and we just had to prove we had a 12 month contract with the marina berth, on a letter from the marina and also receipts for payment, for the address we required. We use the marina address (Yacht name, berth number, marina office) as our mailing address here.

However, that was before Dec 2020 so not sure if the rules have changed?

We used an advisor here to deal with getting the TIE cards (new residency for Brits format and this comes with an NIE) for most of it and being Spain there were of course anomalies dependant upon what official looked at what document for example.

Depends on the country. Some countries have tax agreements so you dont pay tax twice (like on pensions, investments) And on a non lucrative visa there would be technically no Spanish income.

Morning, we have residencia for 5 years so no rush, and the plan for us is a few years more here in the Canaries and then head north to the Med where we can spend as long as we want in Spanish areas (as Spanish residents) and use that to reset the schengen zone rules of 90 in 180 as I believe that even with Spanish residency you ar enot exempt from the schengen zone rules. That is only if you are an EU citizen I believe.

Regarding the taxes, we paid a tax specialist to look at our situations before we went ahead with the residencia as there are a lot of different taxes etc here that you could be liable for.

Hope that helps and we did not have any contact with the consulate, but that was before the UK fully left the EU so we managed to get it sorted prior to the new requirements regarding visas etc

Just one question, have you any income derived in Spain and do you pay any direct (wealth, income taxes etc.) in Spain or are you fully taxed by HMRC in the UK?

ps Possibly should add, we are Portuguese residents with a boat in Portugal but the family have a house in Spain. Thought about applying for Spanish residency but can’t see any advantage and I am not sure, as Brits, we could hold both Portuguese and Spanish residencies?

Met a guy who did. He also had Greek and French residency. Yes 4 residencies and he used to travel between. A retired lawyer, he reckoned he only paid tax in the UK but that was before Brexit.

Thanks. Good idea about consulting a tax lawyer. We have to consult one anyways to wrap up our affairs here so we’ll just add that to the list.
It is my understanding that with a visa+residency the Schengen 90/180 is not needed and travel is open. That freedom is our entire reason for this - so we can extend our boating season and not have to hop around. Some visas do not include residency but the non lucrative visa does.

I wonder if that guy was (bsing or) referring to homes in those countries bc in order to get any 1 of those you have to spend 183 days in that country…more if you want citizenship. Math doesnt add up for more than 1 every 5 years (only once also getting citizenship and many countries dont let you hold multiple citizenships…. But perhaps diff in EU) Unless , I guess, if he bought the golden/investment visas in all those countries and maintains them….

With residency in Spain you still have 90/180 days outside Spain but will be a bit difficult for them realize you have overstayed your welcome.

Depends on just how much data next year's Schengen Information System rollout starts to collect.
