Motor Boat engine Cummins....SOS

For the past 30 years I have been building yachts I have always preferred engines made by Yanmar, Volvo-Penta, Cummins and Caterpillar, which for a long operating life have shown a good performance.

But for last several years I have faced problems I would like to tell you about in order to warn those who might face them later, and probably to ask an advice of those who could have similar problems.

In the Caterpillar 1500 hp engine under warranty the cylinder head gasket has been replaced (because of a burr as a workmanship defect). However after replacement of the gasket the oil started to leak. The factory has been rejecting to repair this defect under warranty requiring 3.500 euro for the job. What should we do?

With Cummins it was not just a mere trouble but an outrageous story, which could be explained only by a poor quality of its engines and irresponsibility of factory management, dealers and sellers.

Troubles started long before the installation. We have ordered engine and gearbox, paid but received those 2.5 months behind the schedule. It turned out that Cummins just happened …to lose our “order”, which was found lying around outdoors. Surely, without appropriate storage conditions the engine lost its marketable state, hoses and wires turned to crack, some parts got rusty. However Cummins refused to correct its mistakes. Moreover, after installation of the engine on the yacht Cummins refused to issue us an engine certificate alleging as a reason that the factory we build our yacht at owed Cummins money – I emphasize, not us who ordered the engine but the plant. Finally, for 3.5 months we have not been able to get engine started and the inspector from register of shipping does not sign an acceptance report because we have no certificate.


When communicating with other customers of Cummins we have found that this was not the first incident with its engines. This company has repeatedly refused to issue certificates for its engines, while inspections and tests revealed serious defects. I know that one fishing boat sank due to a failure of Cummins engine which became jammed and had the gearbox torn off. 6 sailors died. One more fact: on a supporting boat of Abramovich (Russia's richest man) the engine had the turbo torn off and the mechanic of the boat was injured seriously. Should we talk to Cummins at Lloyd Register, court and shipping register, and ask Cummins to stop to put people in risk of death?

Everybody, who can help: please advise what to do in such an outrageous situation. SOS, SOS, SOS!!!!

I have twin Cummins qsc 8.3 engines in my boat which were made in the us delvered into Aus and fitted into the boat and the boat delivered into the uk.

I must say enigines in great condition so maybe its is down to the local dealers? or sub dealers that just dont care but not Cummins themselves?

Hi Dont really know what to say, it sounds outrageous that 2 main firms should treat a boat builder like this, however some boat builders treat there end users the same, we had one on here in the last few months.

To be honest its not unknown to have certain problems when you think worldwide how many units are build and sold by cummins and CAT though the yanks usually pride themselves on there product.

Time for forum lagal eagles to answer this one I think.

Dmitry, sorry to hear of those troubles. Ity's hard to comment though, without hearing the other side's outline argument. Also, the legal answer depends entirely on which country's laws apply to (a) the purchase contract and (b) the warranty contract. That could be russian law? Or the law of the shipyard country? Most legal eagles on here are UK

No doubt you'd like in these circumstnaces UK law to apply but you cannot be at all sure of getting that result, as Yugraneft found to their cost on 29 October 2008 when they lost their jurisdiction battle in their case agiainst Abramovich and Berezovsky

Gawd, and there was me feeling good about my 200hp Cummins Mercruiser turbodiesel after two years and with 300 hours on the clock !!

Sorry to hear of your problems Dmitry, cannot think what to suggest you try.

There are many boat shows coming up over the next few months. I suggest you visit them and stand in front of the Cat and Cummins stands with big notices explaining your problems and handing out leaflets to any passers by. That should make them at least talk to you. For sure you will be chucked out by the organisers but you can cause them embarassment

We had a warranty issue with a valve on a fuel pump, Cummins insisted on changing whole pump /forums/images/graemlins/confused.gif
Just the valve would have done the job, also another boat bought the same time as us had an oil leak fixed by replacing the whole engine. Both EBY boats so I can only think that any problems are a local issue / misunderstanding.

Dmitry,

CAT and Cummins are pretty much top of the tree when it comes to warranty. In the U.S. unless you perform you get your ass sued.

Your issue appears to be with your distributor, however very difficult to unravel without real facts.

In the U.S. and Australia Cummins rank top in customers satisfaction surveys, with the Cummins C Series singled out at #1 engine option for vessel resale value. The B Series is still the only engine to survive the U.S. Navy 500 hr abuse test. The are no quality issues.

OK for the background, however good engines are they are only as good as the distributor who appears to be plain awful. Having said that I bear the scars of dealing with Russian companies and without being rude I was told that is why they produce the worlds best chess players!

Lloyds will not accept the engine without a certificate from the manufacturer, Cummins like all engine manufacturers need to do installation 'sign off' The warranty does not start until the installation meets the manufacturers requirements, if engine is not signed off you have NO WARRANTY WHATSOEVER that is why you had to pay for the repair.

It is also 99% likely that the engine failures have been caused by not meeting the installation requirements in the first place! However here is the rub 'somebody has to pay' and if monies are owed no engineer will come to do trials, no warranty, no installation sign off no Lloyds approval.

Boats go to sea without properly installed engines that will go bang and people are likely to die.

Using the internet to try and blackmail companies into giving you want is NOT the answer.

CAT activly persue this mischievious activity and set the legal eagles loose on the websites pushing this type of undatabased stuff, I certainly do not approve of that either.

I wouldn't be scared off buying Cummins engines they are, far as I'm concerned the best

If some one other than a company engineer fits an engine why would you or any one expect warranty
any dealings I've had with Cummins dealers has been good
If you have a case take it to court where you should have gone in the first place
