Just read a Notice to Mariners on the HHA site that says there’s two fixed red lights at the above. I wasn’t aware that there was a pontoon at Mistley. Has anyone any further info. I normally only go as far as Wrabness but it would be nice to get ashore sometimes.
 
In February the High Court made a ruling and upheld Free the Quay's application that the quay be given village green status. The following was posted on the FTQ website (TWL is the company that put up the fence):

"TWL’s claim: It follows that the matters raised by TWL whether taken cumulatively or individually do not provide grounds for the registration to be reversed or amended. Accordingly the claim fails."

FTQ have now had the chance to study the verdict in detail and we are delighted with Mr Justice Barling’s robust defence of the Village Green in his judgement.

Simon Bullimore, Chairman of Free the Quay said: “I am delighted with the outcome of the court case and would like to thank the whole community who have continued to support us and have kept faith with the fact that the Village Green status will be upheld. I am confident that in due course the fence will be removed. However, consent for appeal on limited grounds is a possibility for TWL but we won’t know for a couple of weeks if they decide to appeal. We hope, however, that Mr Parker will finally see sense and enter into dialogue with us, as we have always proposed, about a more suitable barrier”.

I have not heard whether TWL will ask for an appeal on limited grounds. Hopefully they won't.

Yes, sadly the fence is still there.

I have heard from Simon Bullimore and it seems Trent Wharfage is applying for permission to appeal the decision in the Court of Appeal. So Free the Quay is currently awaiting a date for a hearing on this application.

It seems incredible that this affair has been ongoing for so many years and cost an awful lot of money, yet common sense has still not prevailed...

Seems incredible - how long can he keep the fence up before he's done for contempt of court? Surely he is required to remove it as soon as is reasonably practicable and not replace it unless and until he appeals successfully against the court ruling.

Sometimes, I despair of our legal system.

There has been a pontoon arrangement at their base for some years now. It looked a bit muddy when I visited some time back

Called there last year for some diesel. Got stuck on the mud on the approach, so had to use the tender. Friendly chap filled cans to brim & only charged me for 10 litres. Rising tide got me off the mud. Sorry didn't enquire about berthing though.

Perhaps give them a phone call?
