Matriculation Tax Spain

as i expect you are aware, this subject has been flogged to death, brought back to life and flogged to death again on the Liveaboard Link.

Personally, i lost the will to keep up with the debate some months ago, but you might find somebody in there who has paid the tax, or knows somebody who has.
 
Try posting this on MoboChat (if you dare venture in there!) I forget who it was, but one of the regulars on there keeps a large mobo in Spain and has been clobbered. As ever, the story is not as simple as that: iirc his boat was registered as a charter business - ironically, I suspect, for tax reasons - and I think this had an effect on his liability, probably because the boat was "owned" by a Spanish charter company.

I think he's the only forumite to admit to being clobbered and, unsuprisingly, he's moving his boat elsewhere.
 
Your right - I have actually spent a lot of time and money getting to the 'truth' of this Tax/Registration and posted a page on my web site about the legal reality of this BUT.....

The way it appears to happen is very different hence the post... I would love to hear from anybody who has actually paid this tax!

Just done a quick search - it was Deleted User. Have a look at this thread here. It doesn't tell the full story but I'm pretty sure the outcome was that he had to pay up. However, his circumstances are unusual (and explained in the thread) so it won't necessarily apply to a Brit keeping his/her boat out in Spain but not resident there him/herself.

The problem is custom and practice - trying to get a real handle on how matriculation tax as actually operated by the mainland authorities...

There also appears to be an age limit for mat tax to be imposed - is allowed to be imposed but all my info on that is anecdotal -

which is why I suspect no resident of Spain - expat - has actually paid it..
 
There is a huge thread on the Cruiser forum started by a Belgian couple who were pounced on by the Guarda Civil and had their yacht arrested for non-registration and non-payment of taxes (not VAT).
The couple were appealing against the seizure when everything went quiet, so I do not know how it was resolved, if at all. The nub of the Guarda action was that if a furrin flagged boat was in Spain more than 138 days it had to register in Spain and pay a tax based on the gross value of the boat. There was much debate about whether the 138 days was in any 12 month period or in any calendar year.

Two boats one a M/B the other a S/Y have just paid this dreadfull tax in Almerimar. They the nasty people slapped two notices on there boats whilst they were back in blighty. BNot a nice thing to find on there return. The S/Y paid E3000. He is about 40ft. Dont know about the M/B

Matriculation tax spain

Has anybody actually ever paid the Spanish Matriculation tax?
No not as yet, but the customs in spain are trying to squeeze the tax from me at present ,even though i am not a resident in spain and my boat is moored there.
Has anyone ever engaged tax lawyers or consultants to challenge spanish customs regarding matriculation tax in spain?

A friend of mine bought a nic 32 about three years ago off a Swiss man and is now flying a Spanish flag,he is a Resident,in fact he is Spanish.There is lots of paperwork involved not only the boat but the radio ete etc.He had to have a "project" ie a naval architect had to produce a plan with sability cals etc as the boat was built befopre a certain age and the Spanish are purposely makeing it difficult to bring in second hand boats.He had to pay a tax on the declared value that can be challenged at alatewr date by the customs.If your really interested I will try and get the fully story.I myself am pondering(still) buying aboat in the uk as oppossed to buying an already flagged Spanish boat.The Spanish boats are expensive compared to a uk boat but the are complete with papers that could cost something in the region of 3000 euros!
 
Have you spoken to any brokers? Would have thought they should be aware, its part of the job, no?

Try Clive at Atlas Marine, La Duquesa or Tom at Carrera Yachting, Benelmadena.

Both very professional.
