Liens and Boat Mortgages

I will shortly be exchanging my lifes savings on an old tub in Trinidad, through one of the local brokers there. Obviously, I will want to make sure that there are no liens (mortgages) or encumbrances that may be attached to the yacht. The broker has stated that they have carried out a liens search and that the yacht is free of such. Would I be able to ask the broker to provide a guarantee to that effect, such that in the vent of there being a lien on the yacht, I would be able to make a claim against the broker?

Yes you are quite able to ask for a warranty. Whether the broker will give you one, or be able to stand behind it when you need him to, is quite another question.

In some jurisdictions (inc the UKs Part 1 registration), charges have to be registered to be valid. You really need a word with a lawyer expert in maritime law int he country of registration.

JJ, it might help to talk to Sir Ian Collett at Ward&McKenzie Yacht Consultants, Ipswich.
tel 01473 255200. He knows all about paperwork and checks They have a local agent in Trinidad as well. Have the tub surveyed !
