But I don't think they have a legal problem, 'cause the tech specs are cleary available anyway.
You can name a pair of running shoes as "world record", as long as you're not promising that anyone can achieve it!...
 
Marina measurements ....

A friend of mine had berth fees based on published data - which funny enough was correct for his boat ... No problem. Next years fees he had been upped into next size bracket ... he'd berthed boat and left it for a few days with anchor hanging over the bow roller ... Yep - Marina just happened to be measuring boats randomly over those few days ... he got copped with an increase.

Result ? Marina refused to back down even though he removed offending anchor from bow roller and stowed it normally on its chocks on deck ......... so he cancelled his berth on finding alternative marina nearby who charged him correctly.

I understand Marinas arguments against using Official LOA - as that doesn't include appendages .. which occupy space. But the above illustrates the intransigence / the money grab stance of some who take it to the nth degree.

Handy tip: if you decide to argue with the guy who's doing the measuring about what should be included, then don't lean over your pulpit to chat to him or you will be included in the measurement too.

Marinas charging by the foot is just a money making scam really.... the pontoon will more than likely take a 40' yacht or a 25' yacht, so should all pay the same - a berth is a berth. I can understand the mooring buoys charging for size a bit because they are space/size dependant.

Eg - Berthon in Lymington .... they have 2 boats per finger ... depending on length. Therefore measurement of boat and charging makes sense - except their charges are "way out of my pocket !!!!"

I think buoy moorings are even less reason to charge for size unless you are a real big boat etc. The average boat doesn't really come into it ... as moorings are laid spaced on average / expected range boat size - not on individuals.

It's pretty much like that in the Baltic - sometimes you just pay a fixed fee no matter how big you are. But in most marinas it's done by category eg. up to 10m, around £10 a night would be typical.

What is much nicer there is the lack of money-grubbing attitude sbc mentioned. I've several times been given a few weeks here or there without charge, where I've stayed a month or two. Generally done with a wave of the hand AFTER I've stayed "Oh, we won't count October then" /forums/images/graemlins/smile.gif This year the marina gave in effect 2 -3 months free of charge, maybe it was even more, at the end of the season they waived half the summer as a gesture of goodwill! I don't think you'd get that on the south coast of England.

I've known a couple of places that have given some free time, but not going to say where.
 
Baltics ....

The "barter" spirit survives in some of the places ... I know I can go from harbour to harbour and pay peanuts instead of official rates ... depends on how you approach the "local" HM. They will also discount for groups / rallyes etc. as often the places are fairly empty .... Many of the "ex-Eastern Block" locations are still to be discovered by mass Yottie hordes ... suits me !!
Even in Pirita - the Olympic Marina of Tallinn - I have never seen any measurement of a boat for fee's .... they are quite happy to take owners word ... ok they do like to see the "Ships Documents" ... so difficult to claim other LOA etc.

I can remember a Yacht Club I was with ... we had to state LOA for the Harbour Fee .... at 25ft+ it jumped seriously ... I was charged 26ft ...... which was not correct. I requested review and refund on the difference ... blimey !! 3 cmttee members turned up all official style for the Measurement ceremony !! They had literally told me I didn't know my own boat .... Then a letter into the HM .... That was a Sailing Club !!
