Not if pvb is right, and you know is logic has a ring of truth to it. I wonder if a costless bit of get up and go would open a lot of doors.

You don't need to use a solicitor at all. If you win, the Court fees are refunded. Costs are not awarded in the Small Claims Track.

However ... it's the court which decides which track the claim follows. If the job cost £9,000 then a remedial job may cost above the £10,000 limit.

I think the first stage though simply has to be to contact the company, explain the problem and ask what they plan to do about it.

The simplest solution would be to claim the price paid, not the cost of a remedial job, and this would fall within the Small Claims Track. But I agree that the first step is to contact Mr Spencer, as I suggested earlier.

Small claims is probably the right way to go. Though you must first work out exactly what you are claiming for, after which you must try and settle your claim before taking court action. You should only apply to the court for compensation if you cannot solve the problem by negotiation with [Frank] Spencer Marine Headlining Ltd.

But speaking of legal big guns, and since there is a decent amount of money at stake, why not pm the exceptionally helpful "jfm" on the Mobo Forum; I think he is a big-deal legal eagle in real life and will no doubt help steer you in the right direction.

I would get a properly qualified surveyor (maybe two) to inspect it and make a report. It could be helpful if things come to court.
