I couldn't be bothered reading your second post as it's typically too long, but from my limited legal knowledge "best endeavours" implies a strong legal obligation, not subject to the test of reasonableness.

Also, whether the scheme is or isn't enforceable now is not the issue. Once the legislation is on the table, it can be easily modified later to achieve its real purpose. This is the way many interfering laws are introduced. Take ID cards for instance, how long do you think they will be voluntary?

The real reason IMO is this government's main problem.
They seem bent on introducing schemes that "EMPLOY" people.
Even if these "EMPLOYMENTS" are completely pointless.

The main trouble with this country at the moment is that there are too many people "EMPLOYED" doing completely unnescesary jobs. IMO, its this Labout policy that has got us into this massive mess. The only solution that I can see its to significantly cut public spending but they go on and on with these stupid non essential schemes.

I have spent some time on this matter and have a written change in policy in hard copy that I thought I should pass on to the forum.

I am trying to fight on this issue - so far what have you done to stop it except moan?
 
Yes I agree with that - I have always had this argument with (Mainly Local Government) customers that Best Endeavours is completely open ended - whatever you do, you could always have done better by throwing more money or resources at a problem. Reasonable Endeavours is better IMHO
 
A big thankyou from all of us is required i think . A totaly logical argument against yet another level of red tape being brought in by a government trying to EMPLOY their way out of trouble , maybe we will end up with a man in a little hut on every marina pier head in the country /forums/images/graemlins/laugh.gif .This will go through because nobody will really know much about it and as is the case these days we are all running about like headless chickens trying to pay our TAXES and so no time to put up a fight . Maybe a petition posted at every yacht club and marina would inform boating comunity at large . I can lick stamps etc but no good at clever legal argument , anyone else think of something we could do ??

Even if I lose in my campaign I will have tried and failed - thats better than sitting back accepting this rubbish and confinedmy fighting to just moaning.

One cannot fault your arguments which are no doubt similar to the ones being put forward by the RYA in its formal "discussions" with government on the subject. However, this is a political manifesto commitment in response to equally strong public opinion that our borders are too open. Politicians and their adminstrators are not in the least bit interested in arguments about practicalities, only in being seen to be "doing something".

The issue is trying to show that some control is being introduced, but to my mind this ignores the fact that the current government refuses to use the powers that it already has in law to exclude or eject people who do not have a right to be here.

We just get caught in the crossfire, and there is some merit in letting it all go through so that everybody can ignore it - to which the government is unlikely to have an answer!

On the other hand it might all disappear, along with the drink legislation and a host of other bad and expensive ideas in the forthcoming political upheaval!
 
I agree that the upcoming political upheaval is a good time and that has made me think that i can lobby the shadow home secretary so that they at least understand the issues and can also act as a brake in the meantime. The legislation has already been passed - its the implementation that we are dealing with.
