DREAM YACHT CHARTER and Loic Bonnet are refusing liability…

David vs. Goliath

A DREAM YACHT CHARTER bareboat dragged anchor and collided with my boat in October 2019. Initially they were apologetic and promised to repair any damage caused.

We had a sale pending and a survey was done. A major impact area was found and seawater had seeped into our foam core. This is exceptionally serious. The buyers walked away.

I advised DREAM YACHT CHARTER of the damage and since then and many emails with senior management, I am still trying to get my boat repaired.

In his last email, Kresimir Klaric said - “If you wish to go to court be my guest. Our lawyers will have a field day”.

We have worked so hard to realize our dream and this is our home.

The safety aspect of this is also concerning. Do DREAM YACHT CHARTERS have a safety standard or are they only chasing bookings?

Please sign and help me in asking the CEO Mr Loïc Bonnet to take responsibility for the negligence of the DREAM YACHT CHARTER staff and fleet.

And brave for YBW to allow it to stay up, as you're implying their safety standards are below par.

This is the same as expecting Avis/Hertz etc to take responsibility for a drunk/reckless car rental driver.
Good luck with that.

Claim on your own yacht insurance and leave them to sort out any Third Party Liability. It should be that simple unless you don't have insurance in which case you have a problem but it it is unreasonable to ask this forum to get involved as we don't know both sides of the dispute, for example, who anchored first?

Welcome to the forum. Like several posters I am quietly scratching my head and asking why such a post is your first.

I'm not really aware what a petition will do, it is up to the insurance companies to sort it out. You are insured aren't you?

With or without insurance, I would suspect all bareboat charters will have liability insurance , as their terms of trading , this is a must.
If you are confident that the other boat was at fault, witnesses etc., and as you have eluded to , they have already taken responsibility, hopefully via an email.
Then I suggest small claims court.or if major damage seek a solicitor asap on your rights
Apart from that you will find no answers or solutions, but only stress and wasted time.

I don't think that this accident happened in the UK so it's unlikely that there will be anything like a small claims court or track. The names suggest Croatia but in any of the Med countries, any court action will cost a fortune, will take years, and will either never be resolved or the OP will lose.

We need a lot more information, especially about the OP's insurance cover, before any of it makes much sense.

As others have already suggested, surely the smart move here is to make a claim via your own insurers. If they feel there are grounds to claim against DYC’s insurers they have greater means to pursue this than the OP.
