Do I need a Constituto for Italy?

My boat is UK SSR registers/UK flagged. It is EU VAT paid in the EU at the end of the transitions period, with the required proof. It has only EU citizens on board. Does it need a Constituto for Italy?

I ask because some advisory sites such as Noonsite confuse the issue by suggesting the 'EU VAT paid' and 'EU flagged' are the same thing.
 
Probably,as the Uk is no longer part of the EU,so have lost the right to the free of movement of goods .
so as a uk flagged vessel you will still need to check in and check out with customs and port captain when entering and leaving the country,and possibly between each region in italy to get a clearance certificate.

You will also have to submit a crew list with immigration regardless of passport, and leave a copy of that along with your customs clearance when visiting the port captain to get your outbound port clearance before departure.
if coming and going from outside the EU you might also need a visit from the port health before you can lower your Q flag and get you port health certificate!

Constituto is what exactly?
i assumed you were talking about the need for non Eu vessels to check in and out and get a customs clearance,etc
 
Don't think you need anything except your evidence that the boat is EU VAT paid. Flag state is not connected with VAT status. You may well be checked by officials more often because of the Red Ensign, and you may well find that some are confused by the terms of the withdrawal agreement until things settle down. Suggest you look on the RYA site and the cruising Association as they (particularly the latter) are well up to speed on the rules.

I thought it was passport that decided if you have to check in and out. European passport holders (Non Brit) do not need to check in and out. The boat (Brit flag/EU flag) does not need to check out and check in and out of Italy from EU - (if non Brit passports) unless coming from outside EU like Tunisia. Been in Italy for a bit now! You will need to fill in the online maritime covid thingy. Your Marina in Italy will email it to you. No other papers to stay in Italy (apart from VAT which you have.)
 
I've done a but more research. I believe Noonsite (and other advisory sources) are misleading. From this site....

...it seems like the purpose of the Constituto and associated reporting regime was to register the start of the period of 18 months of temporary importation for non EU VAT paid vessels.

Therefore any UK registered or other 3rd country vessel that is VAT paid in the EU does not need a Constituto.
