Croatia EU VAT - New Advice!?

But all this rulings in Croatia is about the boats which were not imported - into EU or Croatia - before.
So there are two different situations for older boats:

- Boat which have not been imported (and payed VAT in Croatia) is subject to VAT payment - this is required by EU law, not much Croatians can do about. So better to get such boat imported on preferential rate of VAT. There is also custom fee, only on boats produced outside Europe.

- Boat that was imported into Croatia and VAT payed should be considered EU VAT payed, on the basis of EU law. Croatia theoretically may see it different, but it's not for them to regulate, it's EU law. Should they want to charge something - boat owners have an option to sail out to old union, not far away ;) and get this sorted.
Or not even sail - here in Poland VAT status is 'established' in tax office; according to EU regulations. This I have checked. So we can put boat on Polish register, showing papers for VAT payment being done already.

OK .. while we wait for the 8 year rule to clarify ... as my boat is 7 years old ... huummpf :-( ... back to the VAT process....

Anybody got anything more on these EUR1 forms ? How to get them retrospectively ? and info on this "Important: the proof of origin must not be older than four months" malarky ?? any more detailed cost break downs ? restrictions on bouncing in and off the Croatian register ? ... competitive agency costs ?

You can get one via the London Chamber of Commerce, but need to be a U.K. resident. Which country are you resident?

Changing register after 1st July is not clear according to German ADAC. (They issue German registration certificates a bit like SSR.) If EU rules are followed it should be no problem.

Detailed breakdowns I've only seen the SeaHelp website.

SeaHelp ........................ For making this possible, it is necessary to consider that the legal situation in Croatia is changing at the moment.

The Croatian representatives confirmed an obligatory legal situation for December 18th 2012. Actually, this did not happen.

At this point, we expect the situation to be clear at January 25st 2013.

Because of this, we are able to provide an offer including costs and required documents after January 25st 2013.

No, UK Issuing Bodies are only allowed to facilitate preferential exports out of the UK. ATR or EUR1 will have to be issued in the relevant Member State by the exporter’s Agent.
 
Try to ask if there is any other way possible for old boat. Who knows? Custom office, or whoever does it, just need to establish the origins, country where the 'Vehicle was produced'.
I have shown (for boat origins) a scan of sellers brochure, printed from the net. But this was in Poland. They just needed "any document that shows origins" really.

P.S. Since I was, personally, "exporter-importer" of the boat, I have filled the form given to me in place. Going for "certificate of origin". This way was used for "used vehicle".

I had several inquiries from forum members. There are questions about what work will be done by consultants during import. Below is general overview.

Still investigating the EU Customs issue ... if you didn't end up with an EUR1 form when you exported ... anybody made any progress or taking any actions here ?? - It appears they are trying to force the 1.7% customs charge regardless of EU origin ! - Whats an 'adequate statement on the receipt' ?

Yes .. but my boat was exported 7 years ago .. I don't have an EUR1 - just a load of other papers that prove EU construction / origin and the final receipt showing its exported & Croatia bound?

So what else counts / will be excepted by customs ? or an adequate statement on the receipt ??

My boat was built in France ( Beneteau) sold by their German agent to a german lady who had it delivered to Crotia where it was later bought by an Austrian who after about 7 years sold it to me what is the chance of getting aEuro 1? Just had a quote from a Croatian "handler" which is definitely showing "customs dues" 800euros + "tax dues" 2255Euros so it looks like you still have to pay on yachts over 12m which previously they were saying were exempt.

Total I have been quoted with all the bits and pieces is approx 5300 Euro ( quoted on a boat i valued @ 45000euros.
 
Total cost 5452 euro with included consultant's handling fee of 800 Euro plus 25% croatian VAT :rolleyes:

P.S. There is one small problem. This is calculation with expected harbour master office fee of 540 Euro which is in pipeline but not signrd jet. At the moment in force is 1500 Euro fee.

This title is not existing in Croatia. In Croatia are existing only Sworn court surveyors and in case of dispute they can be involved in porcess. I am Sworn court surveyor for marine engineering and naval architecture. Every year i am doing 100-ds of boat valuations for different institutions (banks, leasing companies, court, custom office, tax office). If value issue of your boat is going to complicate i can do valuation. For my client this charge will be only 200 euro. I am not mentioning this service because yacht import is interest of Croatian government and all institutions have ordere to work smooth. Government badly need 150.000.000 milion euros from this project. So noting to worry. You should honestly valuate your boat, we will see what Eurotax book is saying and apply price which should not be subject of discussiion. If for whotsoever reason will be, we have solution. Please note that your boat will be in hand of leading yacht consultants in Adriatic. If we will make any error we have our liability insurance of 100000 Euros, but we are not making errors :cool: and our insurance policy was never used in the past.

All the Agents seem to be dodging the EU Customs 1.7 % issue (that boats with EU origin shouldn't have to pay the customs fees) ... if they have 'an adequate statement on the receipt' ?? ... BUT just what is an 'adequate statement' ?? ... Thats all we need to know ??
