Croatia EU VAT - New Advice!?

You are raelly hard minded. Please be awarw that is Croatian law that all boats need to pay 1.7 % custom dues. Examped are the only boats which have EURO 1 what is mission impossible for the majority of boats in service. Problem is creating number of incopetetive Croatian consultants which just want grab money and offering services without proper preparation. I can see lot of cry after July 1st 2013 :(

and an evidence of preferential origin has been produced (EUR1 form or an
adequate statement on the receipt
)
'
I am really sorry - can't say for Croatia, but if this may be of help:
here it just means "something other but clearly stating the place of origin on receipt from seller, the document from sale provided by original seller/producer . So I guess the original receipt from, was it Beneteau?
Custom fee will not be required for instance for boat from Poland made before we joined EU, so older kind of receipt, non EU, will show. We were in CEFTA. People here also are unsure, though.

@Rossynat

@Maritimus - As per the Croatian Law importation rules (document you have attached - Page 1 point 8) it clearly states that having 'OR an adequate statement on the receipt' is enough to be exempt the import tax .... I am asking what an 'adequate statement' is ??

8. Is customs duty charged on importation of vessels?
The import duty on importation shall be charged at the
rate of 1.7% or 2.7%. However, if the vessel originates from
the EU, CEFTA, EFTA countries or Turkey and an evidence
of preferential origin has been produced (EUR1 form or an
adequate statement on the receipt
), the preferential rate of
duty in the amount of 0% shall be charged. If no evidence of
preferential origin is submitted at the importation, the basic
rate of duty shall be charged. The base of duty shall be the
customs value of the vessel.

Not really hard minded - just asking the question on what is written .... unless I don't understand the Croatian meaning of 'OR' (i.e. one OR the other) ?

I am sure that many owners don't have an EUR1 - but they may have on their paperwork records of EU production / origin and final export destination etc - is this enough ?? Perhaps you can check with Croatian Customs on this threads behalf and become the Consultant with the answer ? An advantage to you perhaps ....

Exactly - as I was importing my boat to Poland, I had to prove she was produced (and imported) in EU country, UK in this instance - otherwise I would be charged custom fee. (and Vat...) Our office accepted any document, absolutely any, that shows country of origin; it's understandable that somebody who purchased old used boat has only his own bill of sale from previous owner. The producer is gone for 30 years; I also would not be able to obtain EUR1, none the less my country has no right to charge me on boat from EU.

Naturally Croatia has own requirements as to documentation - and people would like to know those...

But these are not common rules - Your Country own rules, I understand.
Had I bought boat in Republika Hrvatska - also no custom due, as we have agreements in CEFTA (Central European Free Trade Agreement) :)
So what stands for "adequate statement" - may I inquire from curiosity? :confused:

Granted. We know. So what?

Maybe once again: what paper stands in Croatia for "country of origin" of old boat?
Because EUR1 form is only for new, and only for EU. And you are not even in EU ... :)

The 0% Customs Rule is in force NOW! Croatia is already part to the EU Free Trade Agreement and has been for some time.

@Maritimus - Please can you answer the question from page 1 point 8 - What is 'an adequate statement on the receipt' ? That is all we need to know.

@Baggywrinkle - if you're still around - can you let me have the email address you used earlier in the thread to query the 8 year rule ... I will try and contact them direct - was it the Croatian Chamber of Commerce ? - Ta

"EUR1 form or an adequate statement on the receipt"-Isn't this clear? For me yes. Statement adequate to EUR 1. What is this you should ask Mr Mađer whi is coordinating this action in Croatian Chamber of Economy on mail nautika@hgk.hr He is very cooperative.

I just had this reply from the Chamber of Commerce.
" If your vessell has an EU Goods status , ou are not obliged to pay any taxes. Hoewever if your vessell does not have an EU Goods Status or has lost it, then you are one again obliged to regulate its VAT and customs duty status".
I am still in the dark!!

Let's finish this issue forewer as fare as i am concerned. Only boats which can present EUR 1 are examped from paying custom tax. All boat have to pay VAT 5%. You can put this up or down, left or right , inside or outside, ask president of Croatia but things will not change. If you can accept this live on light if not continue enjoying dark.
