following up previous posts, this has now been received from the belgian embassy - no doubts about it, even if you have receipts marked duty paid, the belgians will fine you

Dear Mr Calver,

I apologize for the somewhat belated reply to your last email but I wanted to make sure I had all pertinent information in my possession before coming back to you.

Although I understand the difficult position you and other British cruisers are in, I have to confirm that Belgium will indeed continue to fine pleasure vessels using dyed diesel. EU legislation clearly does not allow the use of dyed diesel for leisure vessels and Member States have to conform to this. It is worth noting that Belgium also used to allow for an exemption for pleasure vessels but put an end to it on the 31st of December 2006 in order to be in conformity with said EU legislation.

Belgian authorities have been in contact both with their British counterparts and with the Commission to explain it had no other choice but to implement EU legislation. Not doing so could be considered as an infringement. The Commission has never berated Belgium for its practice of fining the use of dyed diesel. Quite to the contrary, it is my understanding that the Commission has asked British authorities for explanations pertaining to its continued use of dyed diesel and started an investigation against the UK . Some of the confusion surrounding this question arises from early letters from the Commission which unfortunately contain some inaccurate information. As mentioned in my first email, we are currently waiting for a decision from the Commission and will in the meantime continue to respect and implement the EU legislation on the use of diesel.

So - Belgium disagrees with the UK's decision to continue with dyed fuel (although I believe this is going to change?) so takes it out on individual members of that state ... somewhat bully boy tactics I think as "we" the individual have little choice as to the colour of our fuel ...
Well, I wasn't intending on visiting anyway ... but I'll ensure I don't now ...

This EU legislation is all very one-sided, and as a Non-EU supporter, the quicker we get out of it, the better!

Fro example. The new legislation for the use of battery hen cages comes into effect soon. The UK has complied, putting some egg producers out of business, but the French (one of several EU members) have refused to comply!! Some member States seem to interpret the rules to suit themselves!

One scenarion in the EU/Cameron fallout is that presumably France and others will 'adopt' the Belgian position. At worst they get some fines and Brit bashing, at best we arrive with fumes of white diesel in our tanks and have to buy in the EU.

Plonkers. Flares, radios, liferafts,MOB devices,VAT certificates, qualifications, categories, blah di blah. Is it really worth the implied hassle after a lumpy trip across the Channel? When there are so many overpriced EU marinas and foodsuppliers and so much beautiful cruising in Ireland...

Time for the UKBA to step up and earn their keep. Inspections please of every EU visiting vessel for all those unwanted illegals who are sneaked along thru Europe and passed along to the UK. Well, fair's fair, right?

If we have a free vote on the EU, and the public decide we should leave, then we can set our own rules (again). Recover our fishing grounds too, LOL!:D:D:D

Oh please! This has been going on way before Cameron used the veto! There's no indication anywhere I can see that the enforcement of fines will be escalated as a result.

If ever you wanted an example of why we should be out of this bizarre cartel this is a good one.

We are already paying the price (well those who have visited Belgium have anyway) ..
This is NOTHING to do with the recent veto of EU treaty and everything to do with RED DIESEL that the PREVIOUS GOVERNMENT tried to sort.

The simplest way to resolve it will be to make the UK leisure boating diesel white - but it needs to be identifiable as such to deter people putting it in their road vehicles.

The Belgians are crazy, no other word for it. I had always thought it unfair when others have laughed at them but I'm proven wrong, completely and utterly wrong. To ban red is bad enough when it can be proven to be tax paid, but to fine those who try to comply with their dumbarse philosophy but still have traces of pink irrespective of receipts to prove tax paid just has to be the nuttiest thing of the lot.

I would like to think that there is some way we can retaliate, but I doubt we would even if we could because we are too kind hearted, other than go elsewhere and leave them to drink their catpiss beer themselves. Fortunately not a problem for us anymore, but commiserations to our east coast brethren.

Maybe we should boycot Poirot.

Why do we still have red fuel oil? Surely its a crude way of tracing illegal use of farm fuel, heating oil etc. Many marine filling points just rely on the paperwork to distinguish between commercial and private users and use a common tank of fuel.

Sad thing is I cleaned out my tank earlier this year & put the 180+ litres of ever so slightly pink stuff back in. Last time I filled up with red was 2007 - thereafter it's been Dutch or English white.

It's a bit of dilemma - a little bit doesn't look pink at all, but a jerry can full has a slight pink tinge & if they do a chemical trace the red will still be seen to be there, albeit in a tiny quantity.

If they fine you once for a breach could they fine you again & again if you don't remove all chemical traces?
