A boat which is tethered is not underway, and if it is not underway, it cant be making way. The water is passing by it, rather than it passing through the water.
An anchored boat cant possibly have any responsibility for giving way to anything... it's anchored, and doesnt actually have to have anyone on board. Bit like a boat tied to its berth has no responsibility to give way to the boat which is about to mow it down.
