Citylink - don\'t use them!

Slightly boaty related, as i used them to send stuff to the boat, collecting bits and so on.

But before christmas, they took a parcel, signed for it, didn't deliver, didn't look for the parcel, said that they were looking and so on. Then when I said well, it's lost, they said yes, but you have no claim, because it's later than 21 days, so no claim har har. Ah, but you've got to say "it's lost", and then we claim in 21 days, I said. Ah but we "semi-informed" you over three weeks ago, they said, when we sed we would look for it, cos us telling you that we'll look for it means that it is indeed lost, and you didn't claim. Cheaty gits! And now their solicitors are on to us for the 50 quid or whatever it should have cost!

The best way out of this is to dangle the solicitors on for as long as possible so that they incur monster charges, and eventually I pay them the 50 quid.

Re: clocking up legal fees

Remember, the maximum solicitors charges they can collect from you on a claim this size, even if they instruct a blimmin QC, is £70 (that's assuming you owe them anything, I can't see how you do, surely you are not going to pay their shipping charges?) so if their legal fees become very monster then erm that would be a shame for them wouldn't it

Well don't pay them, they failed to deliver the goods therefore they failed to complete the contract.
(i just got £90 out of ParcelForce for a lost commercial parcel - unheard of, I consider myself lucky if I get a refund of the postage)

It's a bit picky, but in theory they shouldn't be able to lose your parcel. If it was picked up by them it must still be somewhere with them or delivered to the wrong address or stolen. If it fell out of the back of a van and someone hasn't fwded it on then it is stolen. See the T&C for stolen or wrong deliver, see if that puts a difrent angle on it.

correct - they reimburse ...excpt that the 21 days allowed to make a claim has elapsed. Sooo.. since I didn't claim.... there's nothing wrong ...so they want me to pay!

no, i don't get it either! Claim for loss would have to go thru our insurance. Even tho as far as they know, they threw it in the skip at the end of the road. Or nicked it . And seeing as how there's no cliam from us, then we should pay. Good eh?

Send them cash via their own courier network - or at least say you did. If they can find the letter from you then they find the money. And whilst they are at it can they find the one they lost.

BTW Surely if there is no reciepent signature for the lost parcel then irrespecvtive of the time past, it is still in transit and they have not fufilled their side of the contract - to whit delivered it anywhere. Therefore you can't pay for a service you never recieved. If your insurance won't pay for the lost item as CityLink won't admit it's lost then again it must still be in transit.

Don't forget to insist on speaking to their lawyer directly in all cases - this will run up their legal fees <G>

Havoc, fire, confusion, and mis-trust, yes my work here is done...

In for a penny

Get them to come for another parcel, smack the driver, pee in the petrol tank. Plead guilty having taken job as lecturer. They will assess your means and ability to pay fine and you will be allowed 3 years to pay on account of rubbish salary.
Send the payments by TNT or parcelforce and demand receipts from Shittylink. After 5 payments, don't put money in jiffy bag which should contain 6th payment. Blame TNT/Parcelforce and play one off against the other until they've had enough of you. In the meantime buy white transit van and paint it up in shittylink livery. Collect all their parcels and keep them for at least 22 days - then deliver them.
Resign from job as lecturer because of rubbish pay and retire to previous life.

Re: Citylink - don\'t use them!

Some time back the M.D. of a major worldwide Carrier contacted us and asked us to draft an advert for a P.A., this we duly did and sent it to him overnight delivery for his approval of artwork & copy. It failed to arrive and he went ape until 3 days later when it arrived. Someone had taken it out of their 'system' popped a stamp on it and sent it regular mail.
Red faces, I should say so, talk about Poo hitting the fan especially as the advert was extremely urgent and their M.D. was involved.

Do like I did the other week with the speakers. Stick them in the small claims court. It's only filling a form in. Mind you it wlll cost you £80 to get your £50 back. Then £25 to get the £80. Then, I dont know after that. Anyway it's worth it for the satisfaction of getting a letter saying that the baliff has been sent in.
