following the incedent in the fog last month when the Arco Arun collided with 15 yachts in fog, I was speaking with one of the boat owners about his progress with the claim...

He said that hanson, the owners of the Arun, were not returning his calls and emails, and were denying responsibility! Fairly bizarre when there is at least one witness to the collision!

He's insured with a mutual insurance company, which means he has to do a degree of the running around himself..

Also, when I spoke to a manager at peel ports, I asked if the pilot had been breathalyser, he wouldn't answer, saying that will all come out as a result of the investigation... Strange, since I wouldnhave thought that was a matter of fact, so shouldn't be relevant to any investigation...

Will there be an MAIB report, or is that only when there is a loss of life?
 
then an approach ought to be made formally to the Press Office of Hanson, saying that the reputation of the group is being compromised. Pretty shoddy service if they are doing nothing.

So you who doesn't have a damaged boat asked Peel and they said it will all be in the investigation report. Seems an adequate response to me.
Will there be an MAIB report, or is that only when there is a loss of life?
Doesn't need loss if life to get MAIB investigation. To get an answer to the question you'd need to ask MAIB. Its not on their investigation list which either means they are happy for Peel to investigate or they don't know about it. Bearing in mind it happened in port and didn't involve rescue if no one called the CG its dependant on the ship or the port reporting it to them.

But they may be happy for Peel to investigate.

Wouldn't be the first time something went unreported, but I agree if its as big as the headlines sound you'd expect they know.

But the kids at Cardiff Bay went unreported for months - I assume because self rescued and no commercial skipper etc.
If it was *MY* boat that was damaged I'd call them up and check. If it was a friends boat I would let my friend call...

Bear in mind that as well as relying on the industry's compulsory reporting procedures, the MAIB is also proactive. They scan the Coastguard logs in their entirety (which can run to hundreds of entries in each 24 hour period), monitor the news, Sea-Web, have a network of personal contacts within the industry and receive information from the public contacting them directly. Not much goes past them.

Not really, they'd called me to ask if I wouldn't mind telling them what happened, as I was a witness to the collisions, and to send them all my pictures taken at the time.

And my tender was involved... Fortunately, I was sleeping on the pontoon at the time!

It is not currently listed as under investigation on the MAIB website. Did you or anyone file a report? http://www.maib.gov.uk/report_an_accident/index.cfm
 
What difference does it make if they were breathalised? If they were and were negative they just can't drive a boat, if they weren't negative they still can't drive a boat but would likely have some legal action taken against them. Will it affect your repairs?

In a non-injury road accident would the police tell you if the other person was drunk? I suspect you might only know if you went to court...

You're jumping the gun a little. My question was was he breathalysed. Not was he drunk.

I'm interested in the policies and procedures for large craft involved in collisions.
 
I would suggest your friend seriously considers changing his insurer upon renewal. He should be getting support he he most needs it.

The RYA became aware of the accident on the morning of 28 October, and later that
day received an interim report from CBYC’s chief instructor. A more comprehensive
report was prepared by members of CBYC and sent to the RYA on 24 November

I'm not sure that makes sense? A car driver has no contract with another driver who crashes into him either...?

Is that what you meant?

If one of your employees illegally does something damaging to me, then by law I have the right to seek recompense, don't I? I may employ an insurance company to do it on my behalf, but I'm guessing that mutual insurance companies don't work like normal insurance companies...
