As secretary of Kip Cruising Club I had this e-mail forwarded to me by Claire Femister RYA Scotland. The only information that I have is what is given below.


I am aware this is an unusual request however I would appreciate if you would circulate this to your members.

I am Sergeant Aileen Graham from Dumfries & Galloway Constabulary . Last year a member of the public contacted us to report that he wished to report a seemingly abandoned 32ft sailing boat named the 'Innocence' as found property. This boat is currently on land at Kingholm Quay near Dumfries being held up by steel joints.

I have been able to contact the previous owner who states he sold the boat for £16,000 approx. 5-6years ago. All he can remember it was to a woman named Campbell from Edinburgh who he thought was in her early 30's at the time. He thought she said something about intending sailing to Greenland. The boat was sold as a result of an advert in Yachting Monthly.

There is no problem with this boat as it is on common ground but it is deteriorating through neglect. I am keen to trace the person who purchased the boat as this will ensure it cannot be claimed as 'found property.' It could be this person has moved on and not told anyone of this purchase.

If the "finders" are hoping for a free yacht they could be dissapointed.Even after the police hand found items over to the finder you dont own them if the original owner turns up later.
(So I was told when my Kids handed a found DVD in to the police station,)

Seems strange to pay £16 000 then abandone the boat .

Well done to the police Sergeant for bothering to at least try.

I post the e-mail I received on this forum to inform forum members of a situation that has arisen and one that somebody may be able to help with. It realy is sad when comments are made about low priority and basicaly waisting Police time.
The Police really are in a damned if they do and damned if they don't situation. How often have we read on this forum about the lack of Police activity and there they were trying to help solve a problem by geting in touch with the RYA and asking them to circulate clubs in the hope of finding an answer. Perhaps this is a good community minded officer in a good part of our country trying to do a good turn.

Thought this was covered by some civil law, that if they hadnt been claimed within a set period, the finder then has free title to them.

I am gladdened that both you and the local Police are trying. Here in our little rural community, we also try to help. Doesn't always succeed, and there are the usual detractors, but please don't stop helping.
I hope there is a happy ending to this story.

My partner was the productions official who took the detail of the "Found property"
Today 26/06/2015 we went to Kingholm Key and sadly it's still there ten plus years on looking very unloved!
Whoever found it should have been allowed to take it, as it's slowly rotting

The big problem at Dumfries is thatthe last Nith Navigation trustee died fifty years ago and the trust is defunct, although it still controls the river and quays. The Port of Dumfries Development Group is doing great stuff, but it will take an act of parliament (Holyrood) to get things properly constituted again. Here's what Kingholm Quay looked like before the group got busy with a JCB a few years back:

Interesting that someone has stepped the mast of Innocence since then. Perhaps she isn't abandoned.
