winter Storage Facility

Has anyone of the Formites had the unpleasant experience of returning to the winter storage facility only to find the unmentionable has happened,being broken into and suffering damage. I was wondering what are the legal obligation of the Storage provider and what are the right's of the boat owner? is it a simple insurance claim for damages or are the Storage operators under a duty of care and as such liable.?

Generally, yards have you sign an agreement absolving them of responsibility for security and damage. It's up to you to protect and inspect your property. Like leaving your car on a car park, it's done at the owner's risk.

I personally find it's a bitter pill to swallow knowing that your efforts in securing you boat for the winter period leaves you with no legal address. It's somewhat of a moral dilemma to state boldly safe and secure premises yet the total onus is with the Boat owner.

I'm afraid the 'safe and secure' bit is relative and is probably true compared with leaving it in a field.

It may be false sense security but I think smaller yards are preferable. The one I use in Leeds has residents on the adjacent canal and a decent group of folk who work on their boats there. They tend to keep an eye out for problems and will give me a call if they are concerned but I realise that is not true everywhere.
