An auction creates a contract between the seller and the bidder. The buyer has bought not won it. I think that's the big difference.
You don't need a contract with someone to have responsibilities.I don't see that. The winner May have a contract with the organiser but as there has been no consideration paid to the boat owner, there is no contract with him. The winner has just been introduced by the auction and becomes an acquaintance not a client.
Not to mention the case where a lady who bought a RTW sailing trip then sued coz she didnt like it
