I've been out of the water for 6 weeks or so for the annual service and antifoul etc. While that's been happening the marina have let other boats use my berth.

Went down on Sunday to check progress and do a few bits, and had a stroll along the pontoon to check the berth was OK. Discovered that one of my pontoon fender/bumpers is missing. The holes where the screw fixings were are all ragged as though the whole thing was dragged off. I surmise someone has side-swiped it and the fixings have given way.

I spoke to the marina and no-one has spotted it or owned up to damaging it or knocking it off.

Do I have any recourse against the marina for damage or loss of the pontoon furniture that I have supplied and that has been lost as a consequence of their sub-let of my berth? Or do I just have to suck it up and shell out £50 for a new one?

At the same marina as you and also lost a deck fender. I also lost my metered power lead !!!!!!!
Lead-turned up - Used by AN Other - but the fender didnt. Dont know if yours was knocked off of nicked, but most of the fingers on North side of C and south side of D have been removed over the winter. I have a feeling that other things have also happened during this period when boats have been moved around.
I had a chat with the office, I would advise you do the same.

Don't think you have a chance. You pay for a berth, not a particular berth. Whilst we all think of a berth as ours, as I understand it the marina is only obliged to provide you with a berth, which in theory can be any on the marina.
so they didn't sub-let your berth, they just let someone use that one rather than any of the other ones. So I reckon you need to get your money out and go to town bolting it on.
If it's any consolation, mine went missing in a similar way over winter while my own boat was in the berth, reckon it was knocked off when it was particularly windy, never did find the blighter? Good news is I have two spare ones, could sell you one if you were closer!
 
I agree with Haydn. Count your blessing they don't charge you for the 'damage' the screws made to their nice pontoon.

As to Philz, was the fender you lost the one I witnessed Kawasaki fixing permanently to the pontoon?
 
....one way to cure the problem is do what my folks did 15 years ago, buy their own 15m berth off MDL on a 50 year lease. It is worth more now that it cost.... however quite an investment!

Personally I would stick to buying a new pontoon fender, but don't spend £50!

FYI I have just purchased 3 fenders from pacer marine, which can also be used as pontoon fenders.. they are flat backed with securing holes top and bottom (if you are looking at then vertically, but obviously for a pontoon mounting you put them horizontally), they also do slightly larger ones, but they are also a lot fatter so I felt would push the boat out a bit far off the pontoon...

Hope the boat is going well.

When you spoke to the office did you speak to Dave or one of his underlings? What tack did you take with them? I'd be interested to know, 'cos if it worked for you hopefully it'll work for me.

Interesting that you've lost one too - in the last 6 months I've now lost 2 normal fenders - attached with a round turn and two half-hitch knots for safety, as well as now this dock fender - so I'm starting to wonder if it might be an idea to invisibly mark them in case we have tea-leaf about on the pontoon.

Why invisibly? You just reminded me to take my fine-tip permanent marker with me tomorrow!

I had fenders go walk-about in Haslar a few years ago, which stopped when I wrote the boat name and berth on them with a marker pen (very tastefully of course).

Think I will do the same with the dock fenders tomorrow.
 
You'll have to keep on doing it - I did mine in 'indelible' black ink. The writing had disappeared completely within three months. Mind you, at least the fenders hadn't. ;)
 
sod paying out £50 just get a few old tyers and fix them on and if the marina
dont like it then get them to put some protection on as thats what you pay their
silly prices for i would of thought.

I spoke to dave. I was sorted no questions no problems. Hes probably seen me berth and thinks its cheaper to buy me a fender than get a new pontoon !!!!
