Lacking any signals to the contrary it looks like Renate Schulte was in the wrong but it could have happened at night with lights showing restricted manouvering the other way round. ( the Renate was in ballast at the time and the Marti Princess was loaded with cement )
 
Unless there is something outside the picture to indicate otherwise, looks like the larger vessel had the other on its starboard bow and should have given way.

There is no such thing as 'Right of Way' in the steering and sailing rules!!
 
isn't the small read and white boat awfully close -
the other two being restricted in their ability to maneuver?
