Trev. The comment on trespass was only in respect of Mirrelles comment that we all have a 'legal right' to board boats/property to sort out what WE don't like or WE perceive as a nuisance.

My comment seems to have sent this off on a tangent which was unintended.

Suns out, blue sky and my cruising chute needs an airing.

Had a similar situation last month, left a totally silent wind generator running, came back to find every single blade snapped off. Tying it up would have been quite acceptable in comparison.

Blood and thunder, this thread has gone on too long.

It's simple Sinbad. You were making a racket and some poor sod took it upon him/herself to tie up your noisy genny. Forget any trespass issues - we all owe it to each other to be considerate and thoughtful when we're sharing a small space with a community of fellow boaters. I'm sure you didn't intentionally cause a nuisance, but nonetheless nuisance you caused. That you now feel agrieved by their perfectly reasonable response reflects badly on you.

Enjoy the weekend and reflect on how you might be a better neighbour in future.

Trespass is clearly only a theoretical issue in this case. What would your damages be? (Answer: £0)

But:

1. Do you think you would have a right to sue the Fire Brigade for trespass if they stepped onto your front lawn to stop your house burning down?

2. Your neighbour might have a right of action for nuisance. Possibly also under noise pollution legislation. He is only taking reasonable action to mitigate your breach.

I think you'll find the fire brigade have an absolute right to do it. So, I seem to remember, does the gas board and one or two others. Also HM C & E have enormous powers to go onto you property and search. They just don't use them very much (inland)

Spent the long weekend on the boat. The noise....jeezez...all those boats with flags and bunting from the top of the mast to the decks, whipping and crackling in the breeze. It drove me mad. Thanks to you guys it was easy to sort. I got out the knife, shinned their masts, cut the halyards and peace reigned once again.

Now I'm just waiting for my neighbours to come around and apologise and buy me those beers...........

ok, ok....just kidding

OK to stop the wind gen to get some sleep etc. But he should start it again when he leaves, as the owner might be away for a prolonged period and then return to flat batteries.
More akin to unplugging someone's shore supply so you can use it than tying back a halyard. You would plug their supply back in when you have finished with it, but you wouldn't untie their halyard.
