what happens to MDL berth if I sell my boat??

I have a serious offer on my boat which is in the MDL Torquay Marina.,on an annual contract paid monthly. If the sale goes through, I am unlikely to get my preferred boat (Sealine S28) much before March, and will need to move berths asthe current one will be too short .Question is, would the existing contract be cancelled along with any further payments, and then a new contract started with the new boat, or will I still owe the remainder of the money due for this year? The outcome of this will decide if I accept the offer.
 
there is a section on this in the contract. Can not find mine at present.
But sure they "suspend" the account .

Best bet is to give MDL a call and they will advise
 
It should say what your options are in the contract that you signed. The marina will be able to tell you and whether they might be open to negotiation to accommodate your requirements if the contract says otherwise.
 
With ours were in 2 minds between putting our 25 ft cuddy in on an annual contract (starting in May) and suspending beteeen June and end July (as we pxd) pending build and delivery of the new one.

The office were very good, and from memory they do a calculation based on the differential between monthly and annual contract and they worked out the cheapest for us.

I think there is a suspension formula in their contract, ill see if I can dig it out, but short answer is you will probably be out of pocket, but not as much as you thought...

We dealt with Kerrie who was really good and patient but I think she may not return until the new year, but in my dealings with them they seem open and want to do the best for you as a customer.... especially if you plan to keep the new one with them..as they say everything is up for negotiation,..

Speak to the marina office, but when my S24 turned into an S28, they asked me to pay the difference between the two for the proportion of the year left, as it was an immediate exchange. I think I signed an updated contract to cover the rest of the year, and a new "boat details" form.

If there will be a gap, then you can get something back for the remainder of the season, and for next year you could start again from March, but you might find that the "refund" from finishing early and starting late is very small.

they suspend the contract, send you an email stating how much credit is on the account and you then use that credit against the cost of the annual berthing for the new boat. this is the email we received when we changed boats mid season "Yes I can confirm that your account has been suspended, your credit balance on account to be used against your new boat is £xxxx.xx"

The OP won't have a credit (or no more than a month which he will probably lose anyway if he has to give 4 weeks notice) as he says he pays monthly. I think his concern is that he will have to carry on making payments on an empty berth and whether or not that will then be turned into a credit.

Just my tuppence worth but if you have a serious offer on your boat I would accept it regardless of the question of your berthing arrangements with MDL. There are more boats for sale than buyers.

FWIW I recently had a serious offer on my boat and I accepted it .The boat is now sold. The boat was and still is berthed with MDL who allowed me to assign the unexpired portion of my twelve month berthing contract to the buyer who is now liable to pay the remaining monthly instalments:)

This! A friend has his boat up for sale at MDL Cobbs Quay and wants to move it to the broker at Parkstone Bay. He pays monthly but when he looked to cancel, you have signed a contract for the year so you have to keep making the payments so he's leaving it there until the end of March.

I think the OPs circumstance is a little different. Your friend was looking to cancel whereas Ozzie is simply looking to suspend.
 
When I looked into MDL and Premier contracts a few years ago the difference was startling


MDL

If you cancel mid term they charge you seasonal monthly rates so it depends how many months and the season (monthly rates are much more expensive in the summer) as to how much if any you get back.

If you signed in April and used april, may, june , july and aug you would probably be at full years rate anyway.


Premier

full pro rata return as long as they re let your berth ON AN ANNUAL CONTRACT
BUT
if the marina manager decides to re let ALL the other marina berths before yours he can re let your berth on a monthly basis and you don't get anything back.
 
Take a look at the small print. Some marinas have a clause where, if you sold it whilst it was on a berthing contract with them, then they are entitled to commission on the sale. Even if they had nothing to do with the sale.

21. In the event of the sale by the Owner of any vessel moored or stored with the Company other than through the Company as agents the Owner shall pay to the Company a commission of 1% + VAT of the sale price or value realised. The Owner must give prior notice to the Company of the name and address of the Purchaser, Transferee or Mortgagee, as the case may be. If the Company does not receive such notice the liability for the vessel including the mooring fees and other fees and the terms of this Licence shall remain with the Owner

That's absolutely right pete I'm in that situation , I asked for 3 months back, they said no. The very next day I sold my boat and it went off on transport they occupied the berth with another boat yet they say they cannot occupy it on an annual contract. I then asked if I could put another boat on it that didn't belong to me, they said no, I also asked if I could take boat to my paid berth to work on them , they said no. It a one way street and not in the favour of the berth holder which I'm not happy about. I have just seen the redevelopment plans, the area where I am will loose its close by parking and I will have to walk further to my boat( that's IF I renew my contract end of March. I then got an email from them asking me to take part in a customer survey which I did and was very honest of my opinion .


A friend who berths with MDL got a far better deal on his berth, they deferred his time left about 8 months on his contract for when he may return in two years time, you can't get better than that. It certainly makes you think about annual contracts if there really worth it should your situation change for whatever reason.
 
I have been too busy to ring the marina office today, but will do it tomorrow. I was thinking along volvopauls line - if I have to carry on making the monthly payments for the remainder of the contract, I was thinking of letting my friend put his boat on the berth. Will update tomorrow!
