If he sent it recorded delivery he will have a counterfoil with a serial number on it and a telephone number [08459 272100] to call for "confirmation of delivery". He can also ask for "proof of delivery" for an extra fee.

Has he done that? If not - why not?

I posted off a VHF which we agreed a price on. No money arrived and then I was
told it wasn't working when it arrived, then I was told he would check it out. Then I thought for thirty quid I'm not going to get excited about it and gave up trying to get him to send any money. Won't happen again though!!!!

I wonder if it is libellous (or slanderous whichever) to imply someone is dishonest when his name isnt public only to find that he is subsequently named. If it is, then a few posters on here might be feeling uncomfortable. /forums/images/graemlins/shocked.gif

Suggest you post a reply to his latest plea, gently reminding him of the outstanding payment.

Well bully for him. In the meantime you are still out £30 in payment for goods he has. Get him to send you a postal order for the £30. The £30 he is claiming back is his not yours.

Name him so we can all steer clear. In these times we'd all like to know who the crooks are!

Who would send cash unregistered or unrecorded? only a fool or perhaps a liar.

If he has made a claim then why should you have to wait; if he is an honourable man he would ensure you get your money a.s.a.p. anyway, and deal with the claim himself.

I'm afraid it sounds as if you have been duped- is he a regular or a newbie on the scrounge ?

I really do think you should name and shame, logon and real names, so we all know who not to deal with.

What should you do? Other than the above either walk away from this man who has betrayed your trust or as I once did in a furious rage through being tricked over £ 50, resort to the Small Claims Court.

That wasn't a rational decision but I don't regret it , for like you I had irrefutable proof that a contract had been struck and on a matter of principle I felt I had to mete out some punishment.

It cost me another £36 to pursue the matter through the Court and an hour or so of filling up forms, and eventually enforcing the Court's decision through its bailiff.

It wasn't really about the money, although I got that back of course plus the court fees too, it was the satisfaction of knowing I had defeated a lowlife and as the fool refused to pay even after judgement he now has a CCJ on his credit record which will spoil his chances of getting credit for up to 6 years- most satisfying and I was glad he didn't cough up voluntarily.

Another part of your pleasure should you follow this route is that by lodging your claim in Essex, he will have to travel there if he wishes to defend the action- much time and a little more expense for him, otherwise he loses by default.

Totally agree, buyer should pay seller then pursue claim from the Post OFfice for the money HE lost.

However, naming won't achieve anything for MoodySabre, and could only create a load more embarrassment as happened once before.

[/ QUOTE ]If indeed the buyer did send cash by Recorded Delivery, he can't claim anything from Royal Mail - the only service which offers compensation for cash is Special Delivery.

Wouldn't it be interesting if the several non-payers turned out to be the same person?

On Freecycle, we keep a database of people who don't follow the guidelines. If they continue to ignore warnings, they get banned. Perhaps Dan could keep a list of "Non-payers" complaints & ban members who get a second strike?

I have bought 2 items from forum members. One I met to do the exchange, one I paid by BACs. The only problem I have now is I was exposed as a Tracy Edwards fan /forums/images/graemlins/wink.gif I have never sold anything but did respond to a person who was looking for a couple of user manuals. I spent time and money copying and posting them off, my only request was to send money for postage, it was about a fiver. I never even received a thankyou. Until the matter is resolved I don't think naming the person on this forum is the right thing to do, however if you see him/her responding to a for sale add perhaps you could PM the seller telling them of your experience.

I have PM'd DaiB (see his post above) to find out if it is the same person and if it is then I will contact Dan.

His last post was not on Wanted but on For Sale wanting something that was advertised. I have contacted the seller.

On the subject of his claim on the PO - he has obviously realised that cash is not covered so he says he has put in a claim for something else of similar (but greater) value and asked me to collude should I be asked. No, I'm not going there.

I am happy to name by PM only (A Cluedo player has worked this out already.)

I sussed him in about 30 seconds by joining the dots.

I respect your wish not to name and shame but I have posted life jackets, harnesses, charts, plotters etc to ESTABLISHED forumites either on trust .. cheque in post ... or when cheque received, not cleared.

It only takes one bad apple ..........

I think it was Voltaire who said

"All that is required for evil to rule the day is that good men do nothing!"

Whilst I would hardly describe failing to pay £30 owed as evil, the gist of the above is clear. I have made purchases many times this amount based on trust (in the case of the purchaser trusting in the vendors accurate descriptions). All it takes, as has already been said, is one rotten apple to ruin the whole barrel. /forums/images/graemlins/frown.gif

I urge you to take action to recover your money. We all give the benefit of the doubt in these cases, but just stop for a moment and consider what you would have done if the roles were reversed. I am sure you would have paid up and resolved any dispute with the post office off line.

I have bought & sold on this & other fora with nothing but good results. Hence being happy to set up Marinaskip. Several people have even sent me stuff before I have paid.

There is, by and large, a good deal of trust on here & elsewhere and it is generally well placed. We MUST come down hard on people who abuse the system.
