I was actually agreeing with you - issues of copyright apply when someone makes a copy of something, not when (as you say) they sell a copy of something they obtained legally from the holder of the copyright. You are also correct that one does not have to assert a copyright in order for it to exist. As soon as someone writes a book, for example, they have the copyright to that book.

The reason I suggested going to a solicitor was to ensure that the language is enforceable - I wasn't thinking of enforcement under the CPDA. I was thinking of something like the terms on which credit cards are issued - the card remains the property of the issuer; it is to be used on certain terms; if you breach those terms you have to give the card back (or in the case of the RNLI, account to it for damages).

That would be a minefield. Giving things away with implied terms of use would be very difficult to police and vastly expensive (as would copyright infringement) to act on.
As usual there would only be one winner. The lawyer.

Sorry, you are wrong there. You CAN and should stop them. The way to do so is to send a notice of infringement of copyright to eBay under their VeRO (Verified Rights Owner) programme. Details here.

I have had a lot of success with this. PM me for further information.

Often the fact of contacting can often lead to good result - even if strictly not 100%.

Even courts are known to set precedents and interpretations that do not exactly follow the letter of the law. Laws are to guide and inform. The set ground-rules - that judiciary and the poeple then build on. To keep quoting is missing the point IMHO - the issue is for RNLI to take action and request eBay to remove or dissuade such listings.
Moral issues can and will affect judgements in and out of courts ....(even though many times we feel that it is forgotten).

That is a statute. Judges cannot make judgements outside of the law. Even if they tried, an appeal against the judgement would succeed.

It's called Precedent ... it's how laws often get reformed / amended etc. If a Judge or Court acts outside of Law of course then appeals go in ...

Sorry but this guy has annoyed me ... I've been trying to send complaint to eBay at numerous times today and all his listings with this fail to be accepted in the messages ... keeps returning asking for correct listing ref.
I don't want barrack-room lawyers as well ....

I'm with you. Yes the bloke is probably an arse but it would seem that what he is doing is questionable but not against the rules or laws. I can think of far more important things to get indignant about. Look on the plus side, someone is interested enough in safety to put his hand in his pocket to buy a copy of this guide.
