CE marking and it's attendant approvals relates to product being "placed in the market". This therefore affects the importer or manufacturer within European States and not the user. Using equipment that has, or could cause "harmful interference" would be the issue and that would have to be proved. (Imho). It would be unlikely (again imho) that a piece of equipment from one manufacturer (using same frequencies) would vary much in spec between Europe and the States.
I can't believe that the French officials would have had a case here, unless they were being offered for sale.
