Without knowing the precise details....

of the case you mention, it is difficult to comment.

Maybe the people didn't have the necessary documentation in place from UK Customs (including Customs form C88) to show the T1 procedure was being used. If they just entered Portugual saying they would sort out VAT when they get to UK, without the eveidence, I imagine they could well have had problems. The T1 procedure needs to be set up in advance, it cannot be done retrospectivley.

If they did have the proper documentation from HMCE, I would strongly suggest they write to the EU Directorate of VAT and other turnover Taxes at the EU in Brussels. The people there are very, very knowledgable, helpful, and keen to see that EU Customs Procedures are properly implemented.

The RYA legal dept say it is definately only Madeira and the Azores who benefit fron the 12% rate. Iassume they are correct???!! We are now looking more closely at Spain where Iunderstand they look at the original value when new and then depreciate it on an annnual basis. This is obviously very beneficial for older yachts. A specialist company in Gibralter recently imported a £360,000 yacht into Spain and £17,000 of VAT was paid which seems unbeleivable!
