Tarquin - Trader Saga - do I publish again?

Since doing the deal way back in the Spring with Tarquin Boat Company to unwind the purchase of my Trader with me taking back Drumbeat there has been a fair amount of problems some of which border on the unbelievable.

I am on the point of going public with what the unwind deal was and also how badly it has been executed. The deal itself was agreed as an open and honourable settlement of the matter. So I am now ready to comply with the open bit of that agreement. The unwind deal itself may be of general interest as to how it was done and the way that Tarquin just totally refuse to comply with a written agreement may be of interest – its almost become a soap. I am able to make such a statement because I have written proof as well as verbal undertakings on another matter that were broken the same day as they were made – fortunately left on an answer phone so they knowlingly left a recording and I have the placed the actual recordings on a web site ready for publication.

I am of course ready to publicise the correspondence etc on another web site so that anyone can see for themselves the written and signed agreements and then the written refusal of Tarquin to comply.

At this time I have just 4 post dated cheques (£40k) from Tarquin left plus some disputed amount to about £6k.

I have become very angry with them because of some events which I would describe as incredible over the last 10 days. They refused to comply with a clear agreement both verbally and in writing to me. They ignored my deadlines for no publicity.

So, given that background, do I publish or not?

I can understand those that may be a bit fed up with the saga that unfolded last time but the publicity did, IMHO lead to a solution.

This time the disagreement left is small – about £6k or so but the execution of the agreement has been appalling.

So – over to you, do I call it a day or do I publish and be dammed?
 
Very odd that they'd risk the adverse publicity again in the run up to the Southampton Boat show, especially as it worked last time.

Hope you get it sorted, whether you publish or not.

If the disputed amount is really just £6k (I use the word "just" lightly) then I would be loath to go public just yet. Clearly I don't know the rest of the detail, in which may lie the devil!

Have you got the remainder of the deal sorted - i.e. have you got the bulk of your money plus Drumbeat back? I thought you had sold Drumbeat on B&O?
 
You have the patience of a boxful of saints, but if they are, prima facie, in breach of written and/or (witnessed) verbal agreements, I'd give them a strict time limit - say 72 hours - to come up with the money, and then publish.

Copy your deadline to their solicitors, Boat Shows, that Welsh TV programme.

Looks like "res ipsa loquitur" to me !


Or could this action be the last straw that breaks the trading camel's back ? Is default on the post-dated cheques a possibility ? (No don't answer that one!)
 
I gave them time limits or publicity last week - they ignored them all. By the end of that week i had acheived my objective but the manner in which they point baln refused to hnour an agreement amazed me.

Last Fiday I did receive a lump of £140k, after they had received the VAT back on their credit note. This just leaves 4 post dated cheques of £10,000 each dated to 30th December 2007 plus the disoputed amounts of approx £6k.

Currently I am just very angry about it.
 
If you're sitting on 4 post dated cheques for £40k + a disputed £6k, then you're still out of pocket by £46k so I would'nt wind them up if I was you as cancelling post dated cheques is as easy as picking up the phone to the bank. It's far more important to you that the cheques are honoured than you vent your spleen on this forum about their antics so IMHO, it's more in your interest to hold fire. Get your lawyor involved if they're not upholding parts of your agreement

Although we are all eager to see the publication, the threat is the biggest weapen you have, so I guess I would say don't publish......yet!
I guess if or when you publish, your site will get so many "hits" from forum members that you will be well up in the search engines listings when anyone seaches on "Tarquin"
 
Sounds like a cash flow problem at their end. Any chance of a lien on their assets instead of 4 (WHY FOUR, WHY NOT ONE ???) cheques. December is not that far away, is it ? The £6k should not be the trigger for bringing them down IMHO, but it must be driving you beyond the pain barrier.

Or take a day away fishing, and get back to your normally cheerful state. They could be trying to push you over the limit.
 
excuse my general ignorance but i thought it was illegal to write post dated cheques.

if all you are owed is 46k then if they have assets to that value then it surely must be time to close this dreadful company
 
One query - are the post dated cheques still valid? Might be worth a quick call to the bank to see if you can still present them.

We had some issues with a post dated business cheque that wasn't presented within 180days of date on cheque. Bank considered it was 'stale'.

I hope this isn't a problem here as I am aware the validity duration can change but 180days / six months is fairly normal.

Let them sell a few boats this boat show in order to get your cheques cashed then start again for the six grand and revenge !
 
Does sound suspiciously like either a) They have very few liquid assets at the moment and are robbing Peter to pay Paul or b) They have assets but are tight as a 2 bob note and dragging out paying you until covering debts to them are paid.

My guess would be a)..

I agree with Deleted User. You need to remain objective about this and do what will give the best chance of recovering the owed monies.

I would possibly allow Southampton boat show to pass before going public. I'm sure a single order with a decent deposit will be sufficient to pay what is owed to you.

Have you run a recent credit check on Tarquin?

Keep taking the money, in the current climate I'd put money on Tarquin going next after Peters Opal. Their reputation for service is poor, most of their existing range is outdated and fuel inefficent. The new 42 has had some poor reviews and is a real sluggard with massive fuel guzzling engines. The clock is ticking IMHO.

That's a bit cynical towards the potential buyers of those few boats maybe, but surely the most realistic suggestion so far.
