Storm damage in marina - does the marina have any liability?

Since it was marina equipment which failed, this is why marinas (should) have insurance. We should not have insure ourselves against the negligence of others.

Sorry I take it back, I glazed over the point of "equipment" failure. They are totally liable if they have found that the equipment they are using has not survived a winter storm. Vanuatu winds of 190mph is different as I am sure we can all agree. Then they should hold up their hands and say "Sorry guys our pontoon broke we are liable" The fact that they have not just shows the level of marina they are and not to be recommended.

The quality of a marina is only truly experienced when a problem arises and when it does, "how they deal with it" until then, reviews are only skin deep.

agree - if this has happened a couple of times before and they new that their piles aren't long enough then it must be their fault as it is a totally predictable event that will occur every few years
