Hope you are very well. Unfortunately the saga continues with the marine police herein regards to the time we were stopped in Arjans boat and you were driving. They are saying there could be a 2000 Euro fine now. Arjan and his partner (Manolo) are still fighting this and we may need to show the original of your boat captains certificate / license. Do you have this original available and would you be able to send it to us? (if required). I am not sure if we will need it or not but I wanted to check with you first.

could you directly connect your mates or the police , you should confirm what had happened but not just by the e-mial , and whether it is reasonable ot not , you have to keep the good communication with them before it is settled !:)

Would do but even face to face they don't speak English....i was carrieng passport and photo copies of all my boaty qualifications,Other prob was all three of us shot off to Singapore,Auz and me uk that night.Big problem is we borrowed the boat from a friend but its impounded and he is still in Spain. Who pays the fine if need be?

Was the boat British or Spanish flagged? In Spain, a British skipper is not allowed to captain a Spanish boat (and vice versa).

I don't think that is correct. A Brit can skipper a Spanish boat in Spain - otherwise that would limit your charter options a bit. A Spanish national can't skipper a foreign boat.

In answer to who pays the fine - whoever wants the boat back.

You're right, of course - the rules changed Jan 1 (this year or last).

all I can add is:

get photocopies (possibly duplicates) of your paperwork and if possible get them certified as genuine copies and send them off. Get your ICC translated into Spanish and send this off as well.

Assume the boat is Spanish registered. If, possibly, the insurance is non-Spanish, then make sure you have a copy of insurance in Spanish.

If you/your friend needs some legal advice/support in this then I would recommend http://www.aitamar.com - either talk to Marie-Carmen or her daughter; office is in Campello just north of Alicant.

Good luck!!; and don't forget, u completely understand their (policia) point of view and want to help them clear this matter up as soon as possible; be humble and submissive, etc. etc.

If boat is impounded has it been lifted out?
