hi all seeking advise on chartering my yacht in spain. it is fully mca coded. do i need any sort of spanish licence to operate? if so what sort? or does the right to work any where in the eu apply?
 
You'll need a Spanish tax number, and you'll need to register the business in Spain. Your boat can remain UK registered, but only as long as you spend less than 183 days a year in Spain. If you spend longer, you must become a Spanish tax resident and your boat wil have to be re-registered in Spain.

Either way, the vessel will have to meet Spanish regulations for vessels being chartered, and then you'll need a Spanish skipper's licence. Your best source of information will be a local 'Gestor' who deals in maritime affairs; they're a local institution in Spain, sort of Mr Fixits, who deal with the authorities on taxation and legal issues on behalf of the public.

Don't even think of chartering without a Spanish licence. It's the quick way to lose your boat.

Not necessarily - you can deliver charter services on your NIE ; similar to a sole trader in UK

Not necessarily; all the chit chat with Lemain ISDMT has been in reference to private boats. It's different for UK company owned boats that offer charter services and are recognised as being registered locally.

Yes to both cases. Spanish will require a lift out to inspect/photograph the bottom (and a couple of other features not required for UK charter). Skippers licence is a 15 page document to be completed! In Spain I am a Ferry Captain!

Yes;it is impossible to do it alone.

Latest reg, as of 1/01/09, is that you must have an MMSI VHF radio.

All information you have to supply for resistration must be original documents. Your boat should be UK Part 1 registered as a Commercial Vessel

So true; worst case if you do not have ALL papers on board if inspected is that your boat will be impounded, lifted out, with yard instructions not to be put back in. The yard will then start charging you for storage until the issues are sorted out.
 
thanks all for advise. was only thinking of chartering part time but if its a lot of hassle will probably just get a job in a bar.
