Spain, Covid 19, quarantine and brexit.......

Well for me this summer is now a write off. For a variety of reasons I can't fit quarantine around going to Spain and the rest of the other "planned" events. One of my tasks to sort this summer is possibly re-registering the boat from SSR to Dutch registry as it is still not clear if UK boaters can keep a boat 365 in the EU from January 2021. Really don't want a big Spanish fine and chained to the dock as per the Balearics matriculation tax

Any one got any thoughts? What should we be doing? RYA website is non the wiser.

If anyone is interested I have a very shiny fully serviced Rodman 38 in Spain possibly for sale with new wind deflectors!!!!! well allegedly - I haven't actually seen them, with brand new fenders!!!! just anti fouled with new anodes - spared no expense this year. - where is the I am having a very big sulk smiley????

Still there is always the gardening . JFW.

Move away from Sp before 2021 .
Its a Ex EU boat anyhow if I remember....so will have a VAT trail , ex reg docs from the PO (s) .

As far as proposed 3P status ....nothing changed from a WW pov legally .

Spain is perfectly within its rights to impose its own rules on foreign flagged boats that are based in its waters. In fact this already happens in its neighbour.


This “ British flag = British rules “ debate regularly crops up. I think you need to read Uncloss 11 and other international agreements. The coastal State can impose whatever conditions it wants on vessels NOT on innocent passage. Portugal for instance requires pleasure craft there for more that 6 months to carry the same safety equipment as Portuguese registered ones although unlike a few years ago Portugal where foreign flagged boats that are deemed resident are required to comply with local rules on equipment. New Zealand also applies local rules to foreign boats that are resident, although like Portugal it exempts genuine visitors or boats on "innocent passage".

Innocent passage is an important concept in international law as that is when coastal states apply the principle of "comity" and respect the state flags rules. However once a boat starts cruising within the waters of the coastal state, and that time exceeds 6 months then “innocent passage “no longer applies and with it comity, although in practice most states do extend comity, at least for private leisure craft. That’s the current position within the Med .

What iam saying qualifications could be next post brexit for vessels NOT on innocent passage .
The rest of the “ compliance ‘“ is just a kit list .Most of which you may already have or wisely ought to have .

I wound not get too excited by attempting to hide under another states flag , like Belgium or others .
A lot currently do at the mo .....esp here in Italy the red ensign seems ever so popular with Italians ...up to now ?
Officialdom always ask to see the Passport and reg doc and marry the two up .
It works in Italy because the reg doc states a UK bank as the owner, which technically it is .
I can see you getting challenged post 2121 if your passport + reg doc don’t marry up imho .
Others cant see that ....appreciate that and will promote such .

There are rumours that in future only passport holders of a EU state will be able to acquire its flag .

Covid and countries containment strategy is not related to Brexit .Just a huge problem for Sp which attracts pissheads .
Sp does attract peeps who seem to flout basic social distancing....it’s disappointing for those who try to comply .
The sun beds here in Italy are all marked out 2 M apart , everyone wears masks in shops , bars etc .Social distancing seems to work + hand gel stations + spaced out tables outdoors .....it all feels safe as it should be and the R number seems to stay below 1 .Yesterday 25 July in Italy only 5 deaths + 274 new cases .Switzerland had 12 deaths ....the whole of a June , not one day .
Compare those numbers to Sp + U.K. ......see the problem ?900 odd new cases in Catalonia alone , France 1130 for the whole country with 10/dead .
Plus the elephant in the corner .....flying to Spain ...urgh !

Behind the scenes my view quite subjective a couple of headwinds with Sp .
1- Gibraltar .......they will try and work more aggressively on that post brexit .....= fall out on a wider scale = some collateral damage to boaters .
2 - The fishing thing .....our current stance “UK is going to be a independent coastal state “ post 2021

To enforce the “ fishing thing “ the UK is going to have to stop + search ( read do paperwork = fine them ) Sp + Fr + any others found fishing in our “ independent coastal state ” waters .
Put yourself in the EU shoes .....how can they apply pressure back , get @ us if out border force , fisheries protection and RN are stopping there vessels ?

The argument against is the simplistic tourist €€€ ....shooting in the foot etc .But Corvid has shrink wrapped the tourist economy and dropped into anti tourist , right wing groups lap .On the back of this they may use it to clear out Brits once and for all , leave business and jobs for locals kinda fresh start in a new economy.Sure painful churning it all over but in the longer vision regaining control for Spaniards .
Again the U.K. boating scene based in Sp , be it owners or business will be collaterally damaged .

Corvid is being used to accelerate changes.....even in the U.K. as well btw .

Flying back tonight, as per original plan, a quarantine will be an inconvenience, but not a major problem
