Sorry, another car post but I am flipin annoyed!

From memory, a trader has to offer a 3mth parts and labour minimum. If the 6mths warranty is not on the sales order, or invoice, then it is verbal and you have no comeback, unless you have the conversation recorded of his admittance.

By law, the dealer is entitled to keep your car until payment is made. I would pay the £375 in full and final settlement, on the condition they give you another 6mths warranty - or how do they fancy a VAT inspection.

Pay the 375, get your car, then petrol bomb his garage. Direct action, screw him!

what\'s the warranty worth anyway

when i bought my discovery i was given the usual insurance based warranty (i.e. contact the insurers, don't take it back to the garage). after 3 days the cam belt broke and bent all the pushrods.

i duly took it to the garage specified by the insurers who charged me over £150 of the £300 bill. the excuse was that the warranty excludes oil and antifreeze. now here's the sting... most of the £150 - half the total labour charge - was for 'fitting' that oil and antifreeze.

and the car continued to give all sorts of trouble till i got rid of it

I would agree to pay because really you have no option, on the other hand I don't see why you shouldn't make a condition of payment that he provide the written warranty he promised and never delivered, for a full six months starting now, and deliver the paperwork at the point when you collect the car and pay.

Excellent answer. You could also respectfully suggest that as the fault appeared so quickly after taking delivery of the car the goods were "unmerchantable" to start with whether he knew or not. This leaves the dealer in far more serious trouble legally with the authorities. It might also be a good idea to contact the previous owner and verify why he sold it, any possibility of a fault and very importantly the mileage when sold. All possible arrows for your bow.

You have no choice but to pay so you can get the car back. Then, since you have no warranty and are therefore never likely to do business with him again, go on the attack. Report his insistence on a cash payment to the local VAT office. Black his name on any landrover and four wheel drive websites you can find. Write to the previous owner and ask what the mileage was, if you are very lucky, he's clocked it and then it's a possible prison term! None of these things will get your money back but they will make the loss seem less painful.

Having spoken to the RAC this morning (recomended it for advice), they told me to pay him the money, get the keys and then hand over a letter stating you paid under protest and duress. Then he could see that I am being serious and cave in or I will then send a small claim court order to him and see what he has to say. The RAC said that I had a very strong case regardless of the fact that he sold it with a warranty, this i becuase the goods where not in fir condition for there intended use, he would have dificulty in proving me wrong as I reported the problem almost straight away, also he had made one previous attempt to repair but did not do a satisfactory job. Off this afternoon hopefully so wish me luck! Thanks for everyones kind support and ideas.

It's nice to hear that someone "official" (the RAC) is actually willing to give positive advice and support. If you persist and don't back him too far into a corner, you may be able to reverse the situation so he has no option but to pay up to get you off his back and keep a clean record!

RESULT

Phoned the garage up to ask whether it was ready to pick up, me and my dad drove up there with an envelope stuffed full of purple beer vouchers. Got to the office and was met by a young lad about my age who gave me the keys and said your car is parked there. I turned around and whispered to my Dad "lets get out of here" got in my car a ragged it back home, car fixed and running nicely, I still have my envelope of cash and I bet the guy who gave my car back getting a right bollocking from his fat boss!

So, thanks to everyone that helped me with this one, you are a good bunch.

I would make sure you do not leave the car where it could get put on a low-loader etc. for a bit until you are sure this guy is not going to come after you. Better be safe than sorry. Good luck. Paul

The owner of the well known garage has just called to say that if he does not recieve the £375 by Wednesday he will come down to sunny Bosham with 30 of his Gyspy mates and beat the living crap out of me and my family.
