The article says that the Excise...1979 Act gives the right to 'Rummage.... within the limits of a port'. It then goes on to say that for the UKBA that means all UK territorial waters. Does anyone know if the legality of that interpretation has been questioned or even tested in court? One would have thought that if the Act had intended territorial waters it would have said precisely that.

What I find most interesting is that the article could have been written by anyone who has a perfunctory knowledge of the subject and the civil service. The whole thing was so anodyne and predictable. As one who has witnessed a combined operation of UKBA and the Police ET AL I am having difficulty with reconciling the views expressed in the article with what I have seen. The tone smacks of the establishment self-congratulating the establishment; sorry RYA but you failed spectacularly to hide your true allegiance; and to the UKBA based on what I have SEEN Stalin would be proud to have you on his side if he was still around.

It seems that the RYA will never understand the concept of a persons right to privacy and free movement. They seem happy that as far as UKBA are concerned every yacht on the water is treated as suspicious. They seem to think that being boarded is fine because we're a pretty happy bunch and it gives us an interesting story to tell back at port. And what fun it was to board a couple of hapless, innocent vessels in the Solent.

Apart from this article being a terrible piece of journalism (school of Enid Blyton springs to mind in both writing style and stereotypical views), the UKBA's view on boarding private yachts seems to indicate that this problem is only going to get worse.

Apart from the RYA basically just being a walkover in the interview it would be practically impossible to find stats to disprove the UKBA stats. If you walk down the street and are stopped and searched by the police you will receive a copy of a form to explain when and why it took place. Does the UKBA provide the same, because if not how do we know how many craft they search. I have also witnessed them operating at night without lights which can be justified I suspose until somebody gets run over and in the days of piracy what sort of reacton would you expect to a darkened craft coming alongside at speed. Anyway the only reason they are high profile now is there is a major recession on and cuts are being made. Getting proactive and save their positions is what I think they are doing because up to 2-3 years ago you hardly saw or heard them. In my opinion they have got their heads stuck up a dark place!

I don't think this article is anything to do with whether the UKBA should board our yachts or not, it was about treating us with common courtesy when they did step aboard. That was the question the RYA asked and this article looks suspiciously like their response.

Whether the UKBA should do their job at all is quite another matter, but unless you are laden down with a shipment of Columbia's finest, who gives a damn?

I'm not a member of the RYA, but I do think that the point has rather been missed. Switch back to the horse tranquiliser and stop thinking up pointless idioms. It's about as entertaining as reading the rantings of a crusty old yachtsman who has missed the point.

Could even be an RYA placeman because:
1 Heffalump's line is very similar to that put out by RYA when members protest and
2 RYA have persuaded YBW to pull my earlier post quoting chunks of their email on the grounds that it is defamatory - so they are obviously reading this thread.

It is clear that the article is designed to deal with the 'courtesy when boarding' issue, but the fact that it repeats the "80% of seizures are from yachts" line without any challenge makes it easier for UKBA to board yachts whenever they want even if (say) 99% of seizures are the result of intelligence.
