RYA latest on Red Diesel

The legal requirement that duty exempt diesel must have the marker in it. If they get a rebate then they must by EU law have a marker which I think must be added at source (refinery). The only way to supply white to sailors would be to have a separate way to supply red to fishing boats etc. and given that commercial use far outstrips non commercial use, red is the one that gets sold because nobody can justify a second tank and pump for the paltry quantities that boaters use.

My company recovers the VAT paid on their petrol usage for business; there is no identification added to the petrol.

All allowances are made in a paper exchange at the end of the period.

Remove the dye from red diesel period. If farmer giles or fisherman sam wants to recover the tax paid that is between him and the HMCRE. We then have a single source of fuel available to all.
 
Cant see that argument working. Whats so special about the UK - the other EU countries have found a way to supply white to leisure and red to fishing. The submission needs to find a reason why we cant do what others have done. Length of coastline might be one reason.
 
The UK is only disputing this because it's civil servants don't want to admit that they deliberately misinterpreted the directive's intention, even after the derogation period, when they could see how the rest of Europe had introduced the measure. Belgium got cross because it had the same derogation as the UK but then interpreted the directive as was intended.
 
"White" as sold in the UK is low sulphur and diluted with varying amounts of "bio" diesel so a) lacks the lubricity required for older marine engines unless "bio" diesel is added (5~10%). This leads to b) is prone to fuel bug and c) knackers seals and hoses on older installations. While white may be fine for a road engine with a large turnover in fuel, many boats will have diesel onboard for a full season or more. I know of one vessel still using red bought before all this crapola started with the loss of the derogation - had that been white the tanks would have turned to jelly by now.

Most red is also low sulphur, exactly the same as white and has been for two years

VAT isn't duty though :)
